An unannounced monitoring inspection was conducted on 1/28/2020 in response to a self-reported incident of forbidden action that occurred on 1/23/2020 Interviews were conducted in conjunction with local agencies. Staff interviews were conducted relating to the incident. Based on the information gathered, the allegation is found to be valid and a violation was cited related to the incident.

Standard #: 22VAC40-185-410-1 Description: Based on interviews with staff, the center failed to ensure that physical punishment, striking a child, roughly handling or shaking a child was not used as a form of punishment.
Evidence:
1. Child # 1 was consecutively smacked on the left cheek approximately 2 to 3 times by staff # 1. Verified through interviews with staff # 2 and 3 that staff # 1 was feeding child # 1 (13 months old) lunch on 1/23/2020. Staff # 1 was using her fingers to feed the child. The child bit her on the finger. Staff # 1 showed staff # 2 her finger and then proceeded to smack child # 1 on the left cheek. Child # 1's left cheek was visible red. Staff # 2 stated to staff # 1 that the child's face was red. Staff # 1 stated ?that I did not smack him that hard". Staff # 1 struck child # 1 as a form of punishment which is considered a forbidden action.Plan of Correction: The administration terminated the staff person immediately. Administration has retrained all current staff on forbidden actions and acceptable discipline techniques. All staff is reminded if they need a break from the children to just ask. The administration has ordered camera to be installed into the classrooms as soon as they arrive.
