Technical assistance provided regarding Standard 22VAC40-131-340-F.1, documentation of birth parent involvement in ?developing? the child?s individualized service plan and quarterly progress reports and involvement in ?updating? the service plans as necessary.

Technical assistance provided regarding 22VAC40-131-290.G, documentation of arrangements for the child?s receipt of recommended follow up care.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on July 27, 2020 and concluded on August 5, 2020. The Therapeutic Foster Care Program Director was contacted by telephone to initiate the inspection. The agency reported 38 children in care, and 35 approved provider homes. The agency reports 2 new staff since the last inspection. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed complete 4 child records, 1 additional child record (discharge standards), 5 complete provider home records, 1 additional suspended provider home record, 1 additional provider home record (re-evaluation standards only) and 3 staff records submitted by the agency to ensure documentation was complete. Board Officer records were submitted and reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations were documented on the violation notice issued to the agency. The licensee has five business days from receipt of the inspection documents to complete the section entitled "Plan of correction," sign each page of the inspection documents and return to the Licensing Office. The licensee should retain a copy to be posted at the facility. Results of the inspection are subject to public disclosure and will be posted on the Virginia Department of Social Services public website within five business days, regardless of whether or not the Plan of Correction is completed.

Violations:
Standard #: 22VAC40-131-320-E
Description: Based on the review of the documents presented for foster child (FC) FC-1 and based on an interview with agency representatives (AR), the licensee failed to report a serious incident to the department?s licensing representative within 24 hours following the serious incident.

Findings:
1.Documents presented for review for FC-1 contained the following documents which documented that Serious Incident-A occurred on 07/07/2020: ?Case Note? dated 07/07/2020, ?Medical Care Documentation? dated 07/07/2020 and ?Incident Report? dated 07/07/2020.
2.As of the date of the inspection, the licensing representative has no record of being notified of Serious Incident-A.
3.During the exit interview with agency representatives, AR-1 and AR-4 carefully reviewed the record as well as reviewed their email accounts and were unable to provide any evidence of the licensee reporting Serious Incident-A to the licensing representative.

Plan of Correction: Based on the review and findings of (FC) FC-1, The Up Center will ensure that all serious incidents that involve any medical care or treatment is reported to VADSS licensure specialist within 24 hours of incident occurring. FC supervisors will cc Director of Youth Services on all incident reports submitted via email to licensure specialist.
