Comments:
A monitoring inspection was initiated on 8/17/21 and concluded on 8/20/21. The regional director was contacted by telephone to initiate the inspection. The regional director reported that the current census was 36 children in care and 52 approved provider homes. The inspector emailed the regional director a list of items required to complete the remote documentation review portion of the inspection. The inspector reviewed 4 children records, 8 provider home records and 7 staff records. The exit interview was conducted with 5 agency representatives on 8/20/21 from approximately 9:30 am - 10:00 am, where findings were reviewed and an opportunity was given for questions, as well as for providing any information or documentation which was not available during the inspection.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22VAC40-131-110
Description: Violation:
Based on review of background checks for Staff (S) S2, S3 and S4, the licensee failed to ensure date received for all materials was indicated.

Findings:
The sworn disclosure statements, central registry findings and criminal history records for S2, S3 and S4 failed to indicate date received.

Standard #: 22VAC40-131-40-B
Description: Violation:
Based on review of the DMV driver history record for Provider Home (PH) PH1 and interview with agency representative (AR) AR2, the licensee failed to comply with its own policies and procedures.

Findings:
The licensee's driving record policy signed by PH1 on 4/7/21 documents that any new provider home with -1 to -4 points are recommended to attend driving school and will be placed on vehicular probation for the first year of their approval.

The DMV driving record for PH1 documents a -2 driver point balance. The record for PH1 did not document PH1 completing driving school or being placed on vehicular probation.

During the exit interview, AR2 acknowledged that the licensee's driving record policy was not followed when approving FH1 on 4/7/21.

Description: Violation:
Based on review of background checks for Staff (S) S6, the licensee failed to ensure background checks were completed before three years since the date of the last checks.


Findings:
The most recent sworn disclosure statement for S6 is dated 2/17/21. The previous sworn disclosure statement is dated 11/9/17-beyond 3 years.
The most recent central registry finding for S6 is dated 3/17/21 and the previous central registry finding is dated, 1/7/18- beyond 3 years.
The most recent criminal history record for S6 is dated 2/25/21 and the previous criminal history record is dated 12/21/17- beyond 3 years.
