22VAC40-191 Background Checks for Child Welfare Agencies

An unannounced, on site, monitoring inspection was conducted on February 16, 2022 from 10:00 am to 2:30 pm. The agency is currently working with thirty seven approved providers.
During this inspection, four adoptive home records were reviewed. Background checks were reviewed for seven additional adoptive families approved since the most recent inspection. No personnel records were reviewed as no new staff were hired since the most recent inspection. There were two citations for violations of the Standards for Child-Placing Agencies. One was a key, health and safety standard. The Executive Director was available for the inspection and present for the exit interview at the end of the inspection on 2/16/22.
Upon receipt of the violation notice, the licensee must develop a plan of correction for each violation. The plan of correction must include the following: the steps to correct non-compliance with the standard(s); measures to prevent re-occurrence of non-compliance; person(s) responsible for implementation and monitoring of preventative measure(s); and date by which non-compliance will be corrected. The licensee has ten (10) calendar days from receipt of the inspection documentation to complete the section entitled "Plan of Correction", sign each page of the Plan of Correction and return it to the Licensing Office. The licensee retains a copy to be posted at the facility. Results of the inspection are subject to public disclosure and will be posted on the VDSS web site within five (5) days, regardless of whether or not the Plan of Correction has been completed.

Standard #: 22VAC40-131-200-G Description: Violation: Based on a review of two adoptive home records (AH-3 and AH-4), and an interview with an agency representative (AR-1), the agency failed to address elements on the families' certificates of approval.
Evidence:
1) The certificate of approval for AH-3 did not include an expiration date for the approval or the type of family home approval.
2) The certificate of approval for AH-4 did not include an expiration date for the approval.
3) In an exit interview on 2/16/22, AR-1 acknowledged that the information was not addressed on the certificates of approval as required.Plan of Correction: Not available online. Contact Inspector for more information.
Standard #: 63.2-901.1 B Description: Violation:
22VAC40-191-40.C.3 Based on a review of the background checks for an adoptive home provider (AH-10) and an interview with an agency representative (AR-1), the agency failed to obtain searches of the child abuse and neglect registry maintained by any other state in which the individuals have resided in the last five years.
Evidence:
1) AH-10 was approved as an adoptive family provider.
2) The sworn statements for each parent documented that they resided in a state other than Virginia within the last five years.
3) No searches of the central registry for that state for either parent were requested.
4) In an exit interview on 2/16/22, AR-1 acknowledged that no searches of the central registry for that state for either parent were requested.Plan of Correction: Not available online. Contact Inspector for more information.
