Comments:
Type of inspection: Renewal
An on site inspection was conducted on 11/09/23 from 10:00 am until 2:00 p.m.
An acknowledgement if of inspection form was signed.

Number of children in care: 0
Number of approved provider homes: 21
The licensing inspector completed a tour of the physical plant that included the office setting and conditions.
Number of children?s records reviewed: N/A
Number of staff records reviewed: 2
Number of interviews conducted with staff: 1 entrance and exit interview with the Executive Director.
Observations by licensing inspector: The license was posted along with inspection documents

Additional Comments/Discussion: 2 provider home records were reviewed. 2 corporate officer records were reviewed.

The evidence gathered during the inspection determined non-compliance with applicable standards or laws, and violations were documented on the violation notice issued to the facility. The licensee has the opportunity to submit a plan of correction to indicate how the cited violations will be addressed in order to return the facility to compliance and maintain future compliance with the applicable standard or law.

If the licensee wishes to provide a plan of correction: (i) type the plan on a separate Word document, (ii) identify the standard violation number being addressed, (iii) include the date the violation will be corrected, (IV) do not include any names or confidential information, and (V) return to the licensing inspector by email within five (5) business days of the exit interview.

Compliance with all applicable regulations and law shall be maintained and any areas of noncompliance must be corrected.
Within 15 calendar days of your receipt of the inspection findings (inspection summary, violation notice, and supplemental information), you may request a review and discussion of these findings with the inspector?s immediate supervisor. To make a request for review and discussion, you must contact the licensing supervisor at the regional licensing office that
serves your geographical area.

Regardless of whether a supervisory review has been requested, the results of the inspection will be posted to the DSS public website within 5 business days of your receipt of the Inspection Summary and/ or Violation Notice.
The department?s inspection findings are subject to public disclosure.

Standard #: 22VAC40-131-180-G
Description: Violation: Based on a review of an adoptive home record (AH-1) and an interview with an agency representative (AR-1), the agency failed to obtain 3 references on each applicant as required.

Evidence:
1) The record contained two references on each applicant in the adoptive home of AH-1.
2) In an exit interview on 11/09, AR-1 acknowledged that three references on each applicant were not documented in the record as required.

Description: Violation: Based on a review of an adoptive home record (AH-1) and an interview with an agency representative (AR-1), the agency failed to obtain driving records from the Department of Motor Vehicles for the applicants.

Evidence:
1) The record for AH-1 did not contain driving records from the Department of Motor Vehicles for either applicant.
2) In an exit interview on 11/09/23, AR-1 acknowledged that the DMV checks were not in the record of AH-1 as required.

Description: Violation: Based on a review of an adoptive home record (AH-1) and an interview with an agency representative (AR-1), the agency failed to document that the home complies with the standards for the home as required by 22VAC40-131-190.

Evidence:
1) The record of AH-1 does not document:
22VAC40-131-190.M. The home shall be clean, in good repair, and free of hazards to the health and safety of children in care.
22VAC40-131-190.N The grounds around the home shall be safe, properly maintained, free of litter and debris, and present no hazard to the safety of children in care.
22VAC40-131-190.O The provider shall have a written emergency preparedness and response plan
22VAC40-131-190.P. Approved providers and independent living arrangement settings shall arrange for responsible adults to be available to serve in the caretaker's role in case of emergencies.
22VAC40-131-190.Q. All homes shall have at least one operable smoke detector.
22VAC40-131-190.R. Possession of any weapons, including firearms, in the home or independent living arrangement shall comply with federal and state laws and local ordinances.
22VAC40-131-190.S. The applicant shall maintain documentation that household pets receive tests, inoculations, and licenses as required by law.
22VAC40-131-190.T. The applicant shall ensure that household pets are safe to be around children and that the pets present no health hazard to children in the home.
22VAC40-131-190.U. The applicant shall keep cleaning supplies and other toxic substances stored away from food and, as appropriate, out of reach of children and locked.
22VAC40-131-190.V. Except for medications that require refrigeration, all medications, prescription and nonprescription, shall be stored separately from food in a locked area out of reach of children. The applicant shall implement safety provisions for the storage of refrigerated medications.
22VAC40-131-190.W. The home shall have readily available basic first aid supplies for use in injuries and accidents.
2. In an exit interview on 11/09/23, AR-1 acknowledged that these home environment elements were not documented as being addressed.

Description: Violation: Based on a review of two adoptive home records (AH-1 and AH-2) and an interview with an agency representative (AR-1), the agency failed to document required information on the families' certificates of approval.

Evidence:
1) The certificate of approval for AH-1 did not include the type of family home approval or the issuance and expiration dates as required.
2) The certificate of approval for AH-2 did not include the type of family home approval as required.
3) In an exit interview on 11/09/23, AR-1 acknowledged that required information was not included on the certificates of approval.

Standard #: 22VAC40-191-40-D-1-c
Description: Violation: Based on a review of a personnel record (P-2), a corporate officer record (CO-1), and an interview with an agency representative (AR-1), the agency failed to obtain a repeat criminal background check for an employee and a repeat search of the central registry and a repeat criminal background check for a corporate officer before three years since the most recent search of the central registry and criminal history record report checks.

Evidence:
1) The criminal background check for P-2 contained in the record was dated 10/19/20.
2) The criminal background check for CO-1 contained in the record was dated 7/17/20. The search of the central registry for CO-1 was dated 11/06/20.
2) In an exit interview on 11/09/23, AR-1 acknowledged that the search of the central registry for CO-1 was outdated and that the criminal history record reports for P-2 wand CO-1 were outdated.
