Comments:
A renewal inspection was initiated on 10/18/2021/2021 and concluded on 10/21/2021. The Service Coordinator/Case Manager and Recruiter were contacted by telephone to initiate the inspection. The Services Coordinator/Case Manager reported the current census was five (5).

The inspector emailed the Services Coordinator/Case Manager a list of items required to complete the remote documentation review portion of the inspection. The inspector reviewed two (2) foster child, two (2) staff records, and three (3) provider home records submitted by the facility to ensure documentation was complete. An exit interview was conducted with the Services Coordinator/Case Manager on the date of inspection, where findings were reviewed and an opportunity was given for questions, as well as for providing any information or documentation which was not available during the inspection.

Information gathered during the inspection determined non-compliance(s) with applicable standards or law, and violations were documented on the violation notice issued to the facility.

Standard #: 22VAC40-131-180-J-1
Description: Violation
Based on record reviews and interview, the licensee failed to obtain driving records from the Department of Motor Vehicles for the applicants in Foster Homes 1, 2, and 3 (FH1, FH2, FH3).

Findings:
1) Driving records submitted for inspection for applicants in FH1 and FH3 were from the National Driver Registry.
2) Driving records for the applicants in FH2 were obtained on 6/2/2020 through Verified Credentials, a third party screening service.
3) The findings were discussed during the exit interview. Staff 1 (S1) was interviewed regarding the licensee?s process for obtaining driving records and the requirement to obtain a driving record from the Department of Motor Vehicles was discussed. (S1) acknowledged the findings.

Description: Violation
Based on record reviews and interview, the licensee failed to address required elements in the home study for Foster Homes 1, 2, and 3 (FH1, FH2, and FH3).

Findings:
1) The home study for FH1 did not include a date with the signature of the individual who completed the home study. The signature of the Executive Director?s designee was not dated.

2) The home study narrative for FH2, documented on the agency?s re-evaluation template, did not include or address:
a. the Executive Director or designee signature or date
b. Age and marital history or the applicants.
c. Family history
d. Employment for applicant 2 (A2)
e. Documentation of at least on face-to-face interview conducted with both applicants present
f. Documentation of at least one face-to-face interview with all individuals residing in the home
g. Documentation of information regarding previous applications submitted and approval status by another public or private child-placing agency.

3) The home study narrative for FH3 did not include a date with the signature of the individual who completed the home study or signature of the Executive Director or designee.
4) The findings were discussed during the exit interview and Staff 1 (S1) acknowledged the findings.

Based on record review and interview, the agency failed to ensure the home environment for Foster Home 2 (FH2) was compliant with regulations.

Findings:

1) The home study for FH2 did not include documentation of home environment compliance in the areas of accessible basin and toilet facilities and beds equipped with clean, safe, and comfortable sleeping furnishings
2) The findings were discussed during the exit interview. The Licensing Specialist requested additional documentation of the home environment inspection. Staff 1(S1) submitted a home environment checklist. The checklist did not address the items noted above.

Based on record reviews and interview with Staff (S1), the licensee failed to issue certificates of approval (COA) for Foster Homes 1, 2, and 3 (FH1, FH2, and FH3) that included required elements.

Findings:
1) The signature line for the Executive Director on the COA?s for FH1, FH2, and FH3 were blank.
2) The findings were discussed during the exit interview. S1 acknowledged the COA did not contain the signatures and titles of the individuals approving the home studies.

Description: Violation
Based on record review for Foster Home 2 (FH2) and interview with Staff (S1), the licensee failed to obtain criminal background check results on the applicants prior to approving the home.
Findings:
1) The Criminal background check results letter from the Office of Background Investigations for Applicant 1 (A1) in FH2 was dated as received 195 days following the date the home was approved.
2) The Criminal background check results letter from the Office of Background Investigations for Applicant 2 (A2) in FH2 was dated as received 197 days following the date the home was approved.
3) The findings were discussed during the exit interview. S1 acknowledged the findings.
Staff 1 (S1) explained that she documented the initial approval for this foster home on the agency?s re-evaluation template in error. In using the re-evaluation template, S1 proceeded to obtain Virginia criminal history name search results instead of national fingerprint criminal history results. Upon realizing the error, national fingerprint based criminal history search results were obtained.
