Comments:

A renewal inspection was initiated on July 26, 2021 and concluded on July 28, 2021. The Director of Independent Living was contacted to initiate the inspection. The Director of Independent Living reported that the current census was (6). The inspector emailed the Director of Independent Living a list of items required to complete the remote documentation review portion of the inspection. The inspector reviewed 1 youth record, 2 staff records, and background checks for 2 agency representatives submitted by the agency to ensure documentation was complete. An exit meeting was conducted with the Director of Independent Living on July 28, 2021 where findings were reviewed and an opportunity was given for questions, as well as for providing any information or documentation which was not available during the inspection. Information gathered during the inspection determined non-compliance(s) with applicable standards or law, and a violation was documented on the violation notice issued to the agency.

Description:	Violation: Based on review of the background checks for agency representatives AR1, agency representative AR2, staff S1 and S2, and interview with Staff S1, the agency failed to ensure the background checks (a sworn disclosure statement, a criminal history record, and a search of the central registry) were completed before three years since the dates of the last background checks. Findings: 1. The sworn disclosure statement for AR1 are dated: 12/09/17 and 07/06/2021, the central registry findings are dated: 01/03/2018 and 07/16/2021 and the criminal history record checks are dated: 01/10/2018 and 07/16/2021. 2. The sworn disclosure statement for AR2 are dated: 12/12/2017 and 07/01/2021, the central registry findings are dated: 01/03/2018 and 07/18/2021, and the criminal history record checks are dated 01/10/2018 and 07/16/2021. 3. The sworn disclosure statement for S1 are dated: 12/12/2017 and 07/01/2021, the central registry findings are dated 01/25/2018 and 07/16/2021, and the criminal history record checks are dated 01/10/2018 and 07/19/2021. 4. The sworn disclosure statement for S2 are dated: 01/10/2018 and 07/06/2021, the central registry findings are dated: 02/10/2018 and 0715/2021, and the criminal history record checks are dated 01/31/2018 and 07/16/2021. 5. During an interview with Staff S1, S1 acknowledged the background checks were out of compliance.
Plan of Correction:	Director of HR, Director of IlA, and the Executive Administrative Assistant have incorporated a reminder system on their calendars for early November 2023 to initiate the 3 year renewal of background checks.
