Technical Assistance:
Technical Assistance provided regarding 22VAC40-131-50, the physical office location; due to the shared office building, recommendations were made regarding posting signs and a discussion regarding ensuring confidentiality was conducted.

Comments:
An announced initial inspection was completed on January 24, 2020 from 10:45 am to 1:55 pm at The Bair Foundation, located at 302 Enterprise Drive Bedford, VA. This is an initial inspection to an unlicensed location in response to a new application for licensure. In compliance with licensing requirements for an initial application, the background checks for corporate board officers and agents of the corporation were reviewed. Five (05) personnel records were reviewed, the agency's policies and procedures and the agency's program statement were also reviewed. The physical office was inspected to determine compliance with standards 22VAC40-131-50. Therapeutic Foster Care Program Director was available for the inspection as well as present for the exit interview, which took place on January 24, 2020 at 1:00 pm. An acknowledgement form was signed and left with the licensee at this time.

There was one (1) violation of the Standards for Child Placing Agencies. Upon receipt of the Violation Notice, the licensee is encouraged to develop a plan of correction to include the steps to correct non-compliance with the standard(s); measures to prevent re-occurrence of non-compliance; person(s) responsible for implementation and monitoring of preventative measure(s); and date by which noncompliance will be corrected. The licensee has five business days from receipt of the inspection documents to complete the section entitled "Plan of Correction", sign each page of the inspection documents and return to the Licensing Office. The licensee should retain a copy to be posted at the facility. Results of the inspection are subject to public disclosure and will be posted on the Virginia Department of Social Services public web site within five business days, regardless of whether or not the Plan of Correction is completed.

Standard #: 22VAC40-191-40-D-1-b
Description: Based on the review of the personnel record for Staff 1 (S1) and based on an interview with agency representatives, the licensee failed to provide evidence of a criminal history record check before the end of 30 days of employment at the facility.

Findings:
1. Based on the review of the personnel record for S1, the Background form titled "Virginia Criminal History Record Name Search Request" response section was left blank with no response from the Virginia State Police. This form was signed and dated by S1 on 07/18/2019.
2. Based on the review of the personnel record for S1, the Background form titled "National Criminal Background Check for Employees or Volunteers Providing Care to Children, the Elderly and Disabled" was signed by S1 on 07/18/2019 however, there was no response letter located in the record documenting a response to the request.
3. The date of hire according to a new hire letter that was documented in the personnel record for S1 was listed as 07/11/2019. The date of hire listed on the "Staff Information Sheet" provided by Agency Representative (AR) 1 and AR2 during the entrance interview documented the hire date as 08/05/2019. Considering both dates, 30 days since the date of hire has expired.
