Technical Assistance:
Regarding the current violation, the licensee is reminded of standard 22VAC40-131-200.A.4: Prior to the placement of a child in a home, the licensee shall determine that the home and provider meet the requirements to be approved.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was initiated on June 26, 2020 and concluded on July 7, 2020. The Therapeutic Foster Care Program Director was contacted by telephone to initiate the inspection. The agency reported 9 children in care, and 14 approved provider homes. The agency reports 2 new staff since the last inspection. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed 1 complete child record, 1 additional child record (discharged related areas only), 2 complete provider home records, 9 additional provider home records (background and medical records only) and 2 newly hired staff records submitted by the agency to ensure documentation was complete.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations were documented on the violation notice issued to the agency. The licensee has five business days from receipt of the inspection documents to complete the section entitled "Plan of correction," sign each page of the inspection documents and return to the Licensing Office. The licensee should retain a copy to be posted at the facility. Results of the inspection are subject to public disclosure and will be posted on the Virginia Department of Social Services public website within five business days, regardless of whether or not the Plan of Correction is completed.

Standard #: 22VAC40-191-40-D-4-b
Description: Based on the review of the records for Foster Home (FH) 5 and based on the exit interview with agency representatives (AR), the licensee failed to complete a search of central registry, search of child abuse and neglect registry maintained by another state in which Other Household Member (OHM) #2 resided in the last five years within 30 days of the person becoming 18 years old.

Findings:
1. On a sworn disclosure dated, June 25, 2020, OHM#2 documented residing in another state within the last five years.
2. The licensee did not submit any evidence of the following: search of central registry, search of child abuse and neglect registry maintained by another state in which Other Household Member (OHM) #2 resided in the last five years within 30 days of the person becoming 18 years old.
3. During the exit interview, AR#4 presented evidence that approximately thirty days following OHM#2 turning 18, on 06/30/2020, the search of central registry/search of child abuse and neglect registry application was sent to the state for which OHM#2 resided in within the last five years.

Plan of Correction: All Out of State Central Registry checks for states that the Other Household Member (OHM) resided in within the last 5 years will be completed within 30 days of the OHM turning 18. Supervisors will review all foster home records to ensure that Central Registry checks for OHMs turning 18 are sent and retuned on time.
