Comments:
This inspection was conducted by licensing staff using an alternate remote protocol necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A renewal inspection was initiated on 7/29/2020 and concluded on 8/4/2020. The Administrator was contacted by telephone to initiate the inspection. The Administrator reported that the current census was 84. The inspector emailed the Administrator a list of items required to complete the inspection. The inspection reviewed 5 resident records, 5 staff records, staff schedules, Health Care Oversight, Fire Inspection Report, Health Department Inspection Report, Fire and Emergency drills, and Dietary Oversight submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance (s) with applicable standards or law, and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22VAC40-73-320-A
Description: 320A.7.
Based on record review and discussion, the facility failed to ensure the physical examination report listed the descriptions of the person?s reactions to known allergies.
Evidence: 1. Resident #1?s physical examination report dated 9/27/2019 did not document a description of reactions to the known allergies (Cymbalta, Medrol, Myrbetriq, Provigil, Sulfa drugs, Cipro, and eggs). 2. Staff #1 acknowledged resident #1?s physical examination report did not include the aforementioned information.

Plan of Correction: Steps to correct the noncompliance with the standard
Resident #1?s allergies list has been updated to reflect reactions to known allergies.
Measures to prevent the noncompliance from occurring again

Director of Resident Care and/or designee will review the resident H&P to ensure the allergy reactions are identified and listed.

Director of Resident Care and/or designed will educate licensed clinical staff to ensure allergy reactions are listed on the MAR and ISP
The Executive Director and/or designee will conduct a review of new admission physical examination reports prior to admission for three months.
Person(s) responsible for implementation of each step and/or monitoring preventative measures
The ED is responsible for implantation and monitoring

Description: Based on record review and discussion, the facility failed to ensure it complied with the Virginia Statewide Fire Prevention Code (13VAC5-51) as determined by at least an annual inspection by the appropriate fire official.
Evidence: 1. Staff #1 provided a copy of the facility annual fire inspection dated 8/21/2018. 2. Staff #1 could not provide documentation of an annual fire inspection report, or documentation of correspondence with the fire official documenting the reason for delay of the annual fire inspection.3. Staff #1 confirmed the fire inspection report dated 8/21/2018 and acknowledged the facility did not have an annual fire inspection.

Plan of Correction: Steps to correct the noncompliance with the standard
The Gardens of Virginia Beach has reached out to the appropriate fire officials and has been placed on a list for upcoming inspection. The anticipated time frame of completion is by October 2020.

Measures to prevent the noncompliance from occurring again
The Maintenance Director has been educated on the Virginia Statewide Fire Prevention Code (13VAC5-51) regarding annual inspection by the appropriate fire official.
The Executive Director and/or designee will validate an annual inspection by the appropriate fire official.
Person(s) responsible for implementation of each step and/or monitoring preventative measures
The ED is responsible for implantation and monitoring
