Comments:

This inspection was conducted by licensing staff using an alternate remote protocol necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A complaint was received by the Department regarding allegations in the areas of facility cleanliness and written notice for a rate increase. A complaint investigation was initiated on 2/10/2021 and concluded on 2/11/2021. A virtual complaint inspection was conducted with the facility's administrator on 2/11/2021. Evidence gathered during the investigation supported one of the allegations of non-compliance with applicable standards or laws, and the violation is documented on the violation notice issued to the facility. The provider's response for the "Plan of Correction" was not received as of 4/9/2021 and will not appear on the Violation Notice.

Description:	Based on a review of the resident agreement for one resident, the facility failed to follow it's own policy and procedure. The facility's resident agreement for resident # 1 states "We will provide thirty (30) days written notice of any change in the rates or pricing methods for Basic Services, Personal Services, Select Services and Therapeutic Services." A complaint was received that there was a change in rate for resident # 1 without a written notice. The facility's administrator submitted an email dated 1/29/2021 from the resident's Power of Attorney. There was a handwritten note at the top of the email "Notice sent 1/9/21". There was no documentation provided to support that a thirty (30) day written notice had been given to the resident/resident's responsible party/power of attorney.
