Comments:
An unannounced complaint investigation was initiated on August 13, 2019 and continued on August 16, 2019 with representatives of local agency in response to allegations regarding supervision of children and incident reporting. Based on staff interviews, review of documentation, and review of video footage, the preponderance of evidence gathered during the investigation supports the allegations. Description: Based on record review and staff interview, the facility failed to have a staff record for each staff person. Evidence: there was no staff record available for review for Staff 3 who reportedly returned to work for the summer on (DOH 5/1/2019).

Complaint related: Yes
Description: Based on review of video footage, staff interviews, and review of documentation, the facility failed that when staff are supervising children, they always ensure their care, protection, and guidance. Evidence:
1. Video footage shows on Friday, August 9, 2019 at approximately 3:00 p.m., a ten pound roll of bulletin board paper that was propped on the feeding table fell on the floor near infants playing on the floor. One of the staff picked up the paper and propped it against a crib, adjacent to the playing infants.
2. A few minutes later, Staff 3 accidentally knocked into the roll of bulletin board paper, which struck on or near Child 1 (8 months old). Child 1 is seen falling backwards onto the floor. Staff 3 reported "I accidentally hit the paper. It startled her and she fell back and hit her head."
3. Staff 3 picked up Child 1 and handed her to Staff 2, who was sitting in the rocking chair. Staff 2 held Child 1 until she fell asleep. When she woke, Staff 1 reported that Child 1 "was outside her normal demeanor", "outside her normal fussy", and was "clingy" for the remainder of the afternoon.
4. Staff 2 and Staff 3 state that an incident report was not written. Staff 1 stated that parents were notified by phone and at pick up that Child 1 had a low grade fever., but the parents were not notified that the child had been startled and hit her head.
5. The parents of Child 1 stated the child was "fussy", "not herself" and "could not put weight on one leg." An exam at St. Mary's Hospital on 8/10/2019 diagnosed that Child 1 has a "non displaced fracture in the left femur."

Description: Based on record review, staff scheduling, and staff interview, the facility failed to have at least one staff member who meets the qualifications of a program leader regularly present in each grouping of children. Evidence: Staff 1, Staff 2, and Staff 3 are regularly scheduled as the only staff present in the infant (Baby Birds 1) classroom, but none are qualified to be a program leader.

Description: Based on staff interviews, the facility failed to report a serious injury to a parent immediately. On August 9, 2019, Staff 3 reportedly "hit the yellow paper. It startled [Child 1] and she fell back and hit her head." Eight month old Child 1 hit her head on the hardwood floor. Staff 1, Staff 2, and Staff 3 stated that the front office had not been notified immediately. The parent was not notified of the head injury during a 5:15 p.m. courtesy call or at the time of pick up at 6:00 p.m.
