Comments:
An unannounced monitoring inspection was conducted on initiated on 06/27/2019 in response to a self reported incident that occurred on 06/26/2019 regarding inappropriate behavior guidance. The inspector conducted on site inspections on 07/03/2019, 07/09/2019 and 07/25/2019. Based on the information gathered which included staff interviews, written statements from staff and children, a review of records and classroom observation a violation was found in the area of behavior guidance. The violation is listed on the violation notice and was reviewed with administrative staff at the exit interview.

Violations:
Standard #: 22VAC40-185-400-B
Description: Based on record review and staff interviews, the center failed to ensure that behavior guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts. Evidence: 1. Staff 1 hit child 1 , age six years, on the hand when he failed to follow verbal instructions to stop throwing legos. a. Child 1 and child 2 were playing with legos at approximately 10:43am on 06/26/2019 when child 1 began throwing legos at child 2. b. Staff 1 stated that she asked child 1 to stop and also moved child 2 away from child 1 nevertheless, child 1 continued throwing legs at child 2. c. Staff 1 stated that she told child 1, "Don't make me get up ....you better not hit me." "He threw a handful at me and hit me in the face." d. Staff 1 stated that, " I got up and took the lego out of his hand and I threw the lego back in the area." 2. Staff 2 stated that she observed staff 1 pick up a lego and throw it back in the area where child 1 was sitting. "He (child 1) threw a lego at staff 1 and it hit her." "She picked it up and threw back at him and it landed on the floor." 3. Child 1 stated, in a written statement that staff 1 hit him on the hand after he threw legos at her. Child 1 additionally stated that staff 1 threw legos back at him after he hit her with a lego. 4. A written statement provided by child 2 indicated that he observed staff 1 hit child 1 on the hand after he threw a lego. 5. A written statement provided by child 3 indicated that he observed staff 1 hit child 1 on the left hand after he thew a lego. 6. A written statement provided by child 4 indicated that she observed staff 1 hit child 1 on the hand after child 1 threw legos. 7. The actions of staff 1 did not redirect child 1 to an appropriate behavior or resolve the conflict that resulted from the dispute over the legos with child 2.

Plan of Correction: Following the incident leadership reviewed the Code of Conduct and Child Abuse Prevention Policy with all staff during a staff meeting on June 27, 2019. Staff were also retrained in the following at the meeting: - Y's discipline policy. -Understanding youth with diverse abilities and needs. -Behavior management/guidance strategies for diverse campers and/or campers with diverse needs. Strategies and Policies mentioned above were reviewed with all staff again during 1 on 1 performance evaluation reviews on August 6, 2019 and August 7, 2019.
