Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced code compliance inspection was conducted on 07/09/2024 from 12:05 PM to 1:30 PM. There were 40 children present, ranging in ages from 2 years to 10 years, with six staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, and procedures. A total of five children?s records and six staff?s records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22.1-289.031-B-6
Description: Based on record review and interview, the center failed to implement a procedure to ensure that all staff are able to recognize the signs of child abuse and neglect.

Evidence:

The record for staff 5, employment date 07/01/2024 did not have documentation of staff 5 completing training in recognizing the signs of child abuse and neglect. Staff 5 was working in a classroom with children and stated she had not taken the class yet. The center's procedure is for staff to take the class on recognizing the signs of child abuse and neglect prior to working with children.

Plan of Correction: Staff 5 has been advised to complete the training by 7/10/24 and return the certificate to be filed. In the future the director will ensure all new staff complete the training prior to working with children.
