Technical Assistance:
The provider must send documentation to the LI that the background checks have been requested no later than 10 days following this notification of the Acknowledgement Form. Once the background check is received by the center, the results must be forwarded to the licensing inspector.

Comments:
An unannounced monitoring inspection was conducted on May 30, 2024, from 9:30am-12:45 am. At the time of entrance, ( 78 ) children were in care with (10 ) staff members present. The inspector reviewed 5 children?s records and 5 staff records. Children were observed during snack time, engaged in group circle time, water coloring, umbrella and duck art and outdoor play. Medications were observed. Areas of non-compliance are identified on the violation notice. Repeat violations were found and are identified within this report.

Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Violations:
Standard #: 22.1-289.035-B-4
Description: Based on a review of staff records, 2 staff did not have out of state child abuse and neglect search requested by the end of the staff's 30th day of employment.
Evidence:
The following staff listed on their sworn statement they had resided in a different state within the past 5 years, the child abuse and neglect search was not completed for;
Staff # 2, date of employment 11/15/2022 does not have child abuse results for New York and Washington, DC.
Staff #3, date of employment 10/28/2022 does not have child abuse results for North Carolina.

Plan of Correction: Management will submit the child abuse registry forms for the out of state background checks.

Standard #: 8VAC20-780-270-A
Description: Based on observation, areas of the center is not maintained in a safe, clean and operable condition.
Evidence: In the downstairs toddler classroom, the left hand sided cabinet under the counter has peeling paint on the front cabinet door.

Plan of Correction: A work order was placed for maintenance to repaint the cabinet.

Standard #: 8VAC20-780-280-B
Description: Based on observation, hazardous substances such as cleaning agents was not locked using a safe locking method and were accessible to children.
Evidence: Hazardous substances, such as cleaning agents were found unlocked and accessible to children in the following classrooms;
The 2's/3's classroom had insect repellents under the diaper changing table and cleaners in the cabinet under the sink.
The 3's classroom had cleaners in the tall cabinet

Plan of Correction: A child safety lock will be purchased and placed on the cabinet doors.

Standard #: 8VAC20-780-330-B
Description: Based on observation, resilient surfacing does not comply with the minimum safety standards.
Evidence: The fall zone underneath and surrounding outside playground equipment does not meet the 6 feet resilient surfacing in the following areas.
Little Tykes large blue slide measured about 4 inches of pea gravel surfacing.
Little Tykes cube measured about 2 inches of pea gravel surfacing.
Gametime climber measured 4 inches of pea gravel surfacing and
the swings were bare underneath and measured 2 inches of pea gravel around the swings.

Plan of Correction: Pea gravel will be racked under and around the equipment to maintain the 6 inches of surfacing.

Standard #: 8VAC20-780-510-E
Description: Based on a review of children and medication records, 2 children's records were missing physician and parental authorization to administer medication.
Evidence:
Child # 1 has a medication authorization form dated 12/26/2023, it is missing the parental authorization.
Child # 3 has a medication authorization form, it is missing the physician authorization.

Plan of Correction: The parents will provide the parental and physician authorization on the medication form.
