Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site focused inspection was initiated on 7/3/2024 and completed on 7/3/2024, in response to a situation that was self reported by the child day center. The on-site inspection began at 11:30 am and ended at 12:00 pm. The inspector reviewed compliance in the areas listed above. The inspector reviewed 1 child?s record and 3 staff records on-site. This inspection included document review, tour of the facility, and interviews.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on (date). A POC submitted after this date will not appear on the public website.

Violations:
Standard #: 8VAC20-780-340-G
Description: Children 10 years of age and older shall be within actual sight and sound supervision of staff. On 7/1/2024, Child 1 was brandishing a branch and assaulting staff who had formed a wide circle around the child in efforts to contain them. Child 1 proceeded to evade the containment by staff and jumped over a fence in the rear playground, entering the woods behind the school. The child was out of sight and sound of the staff for five minutes. Following advice from law enforcement, staff did not pursue and maintained a strategic, staggered presence around school in an attempt to contain the child safely until law enforcement arrived.

Plan of Correction: We reviewed school playground and school floor plan and SACC/NCS Active Supervision
We determined that there are two doors located in the back of the school that allows us access to the fenced in area were the child was hiding (Doors #6 and #7)

We reviewed our strategy on how we should position ourselves when following a child that has eloped, instead of cornering him near the fence area, we should have shifted our circle around him to towards the school building until law enforcement arrived.

Positioning ourselves accordingly
Communication with all staff inside the building (Setting up a code so that staff will be aware that we have a child that has or is trying to elope.)
Assign staff that will aid in the event of elopement.
Familiarize all staff of all potential elopement areas and our plan of action incase of a child jumping the fence.
