Comments:
An unannounced joint inspection with a local agency was initiated in the center on September 19, 2023 and completed on October 31, 2023 in response to a self-reported incident regarding Staffing /Supervision, Programs and Special Services. Interviews with staff and parties involved were completed, observations were made, and center documentation was reviewed. Additionally, there were collateral interviews, review of video footage and a review of pertinent documentation during the investigative process.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-70
Description: Based on documentation review and staff interviews, the licensee did not ensure staff records were available for review and completed with all required documentation.

Evidence:
The Center Director verified that Staff #1 did not have a record available for review to include but not limited to their background checks. Center Director confirmed Staff #1 was working on September 6, 2023 as the van driver for the before school program.

Plan of Correction: 1.Staff #1 is no longer employed at the FBCD?CDCA. corrected September 9, 2023
2.The Board of Directors will submit a written reprimand to be placed in the Director?s file for not maintaining the files of employees. corrected November 15, 2023
3.New staff (driver) has cleared all required background checks, fingerprinting, references, and any other required prerequisites as needed for employment. corrected September 18, 2023

Standard #: 8VAC20-780-340-A
Description: Based on video footage review, interviews, and documentation review, it was determined the licensee did not ensure the care and protection and guidance of children.

Evidence:
1.On September 6, 2023, from approximately 9:36 AM until approximately 9:39 AM 5 children, age range 5 through 10, were left alone on the center?s van in a public school?s public parking lot.
2.At 9:39 the school?s security guard opened the door and let the children off the van.
3.The security guard verified the van?s engine was off, the windows were closed, and the driver?s side door was unlocked.
4.The temperature was approximately 85F at 9:34 AM on September 6, 2023 in Newport News Virginia.

Plan of Correction: 1.Staff training and policy implementation emphasizing the importance of being able to see and hear the students at all times.
2.Random ride along with drivers by CDCA Director.
3.Coordinate with Newport News Public Schools and obtain a copy of their drop-off and pick-up policies.
4.Random check-in with Newport News Public Schools Points of Contact/Officials about driver engagement and adherence to safe transportation policy.

Standard #: 8VAC20-780-340-F
Description: Based on video footage review, interviews and documentation review, it was determined the licensee did not ensure children under 10 years of age were within actual sight and sound supervision of staff.

Evidence:
1.On September 6, 2023 at approximately 9:34 AM Staff #1 and 5 children (age range 5 to 10) arrived to a public school?s parking lot.
2.At approximately 9:36 AM, Staff #1 gets out of the van and left the 5 children unsupervised in the van until approximately 9:39 AM when the public school?s security guard went out to the van and escorted the children inside of the school.
3.At 9:41 AM the 5 children entered the school?s office with the security guard and the children were signed into school
4.The 5 children were without sight and sound supervision of Staff#1 for approximately 5 minutes
5. Children #2 through #5 were ages 5 through 7.

Plan of Correction: 1.Implemented a week-long training program for drivers, which includes a review of our Policy and Procedures for Safe Student Transportation and the shadowing of an experienced driver.
2.Implemented the new Policy and Procedures for Safe Student Transportation, which the driver must sign as part of his/her employment onboarding process.
3.Provided detailed instructions on care, guidance, and protection of students with constant sight and sound supervision of children at all times.
4.Enabled availability and immediate access of appropriate Newport News Schools Points of Contact and phone numbers for drop off and pick up.

Description: Based on documentation review and staff interviews, the licensee did not ensure that before the child's first day of attending, parents shall be provided in writing the center's transportation policy.

Evidence: The Center Director verified the center did not have the required transportation policy on September 6, 2023.

Plan of Correction: 1.Developed a new Policy and Procedures for Safe Student Transportation, which outlines all requirements for the safe transport of students. Policy developed-September 11, 2023
2.Incorporated the new policy in the Parent Handbook, which is given to every new parent upon their child?s enrollment in the school.
3.Provide a copy of the new policy to parents of already enrolled students.
