Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. The statutory requirement can be found online at https://law.lis.virginia.gov/vacode/title22.1/chapter14.1/section22.1-289.057/.

Comments:
An unannounced monitoring inspection was conducted on 6/27/2024 from 8:30am-10:50am. At the time of entrance, 13 children, ages 16 months to 4 years old were in care with 3 staff members present. The sample size consisted of 5 children?s records and 5 new staff records. Staff records are stored off site and were reviewed electronically. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition Children were observed eating breakfast which consisted of yogurt, peaches and milk. Hand washing, table sanitizing, and transition to outdoor play were observed. Medication administration was not observed. However, 5 medications stored on site were reviewed with regard to storage, expiration dates, written authorizations, and other required documentation.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-280-B
Description: Based on observation, the licensee did not ensure that potentially hazardous substances such as cleaning materials, insecticides, and pesticides shall be kept in a locked place using a safe locking method that prevents access by children.
Evidence:
There was a spray bottle of disinfecting spray located under the diapering table in the toddler room where 6 toddlers were present during the inspection.
The child lock was looped onto the cabinet handle but was not secured to prevent access.

Plan of Correction: Staff fastened the child protective lock immediately upon notification that it was unlocked. Staff will ensure that the cabinet door is secured with the child safety device when the diapering table (and sanitizing procedure) is not actively in use.

Standard #: 8VAC20-780-290-A-3
Description: Based on observation, staff did not ensure that electrical outlets in areas accessible to children have protective covers installed.
Evidence:
There was one uncapped outlet to the left of the handwashing sink in the preschool classroom where 7 children, ages 3 to 4 years old, were in care.

Plan of Correction: Staff immediately capped the outlet with a protective cover.
Staff will recheck to ensure all electrical outlets are fitted with a protective cover each morning since outlets may be used after closing in the evening and potentially left uncapped.
