Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced code compliance inspection was conducted on 06/20/2024 from 10:10 AM to 11:40 AM. There were 78 children present, ranging in ages from 21 months to 10 years, with 18 staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, and procedures. A total of seven children?s records and seven staff?s records were reviewed.
The information gathered during the inspection determined no violations with applicable standards or law. No violations were issued.

Standard #: 22.1-289.035-A Description: Based on record review and interview, the center failed to update child abuse and neglect background check and sworn statement every 5 years.
Evidence:
The record for staff 2 has a child abuse and neglect background check dated 6/7/19 and a sworn disclosure dated 5/16/19.Plan of Correction: Staff 2 will be required to complete a sworn statement and paperwork for an updated central registry search within 10 days from the date of the inspection. Documentation will be sent to the inspection.
Standard #: 22.1-289.035-B-4 Description: Based on record review and interview, the center failed to request a search of sex offender registry prior to the first day of employment, and a criminal history name check prior to the first day of employment for any state in which a staff member resided in the preceding five years.
Evidence:
The sworn disclosure for staff 6, employment date 8/2023, documented living out of the state of VA in the last five years. The record for staff 6 did not contain a sex offender search or criminal history search for the other state staff 6 lived in.Plan of Correction: The sex offender search was completed during the inspection. The child abuse and neglect search will be processed within 10 days and documentation will be sent to the licensing inspector.
