Comments:
The licensing inspector conducted an unannounced complaint inspection on March 20, 2024 at approximately 9:20 AM. A complaint was received by the licensing department on February 8, 2024 regarding allegations of forbidden action and behavioral guidance. Interviews with staff were completed, observations were made in the center, and documentation was reviewed.

The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details.

Description: Repeat Violation
Based on the review of center policies and procedures and interview, the licensee failed to ensure that the center?s activities are maintained in compliance with the terms of the current license issued by the department.
Evidence:
The center?s employee handbook states the following under supervision of children: Employees shall use positive reinforcement and re-direction to help children move through a difficult moment. Staff #1 reached for child #1?s arm to stop her from walking away when child #1 was angry. Staff #1 used her hand to cup child #1?s chin to speak to child #1 directly.

Plan of Correction: Although the physical contact made was by no mean rough in nature or used as punishment. we acknow-ledge the student should have had the opportunity to collect oneself prior to engaging in conflict resolu-tion with the teacher. Furthermore, if teachers are to be used in alternative classrooms, they must receive appropriate cross-training in order to do so. Management will
assess staffing as a whole and cross train willing teachers to work in different classrooms when necessary. The teachers will spend time in these environments with the lead teachers for modeling purposes as well. In a scenario where a classroom needs additional coverage and there is not a
cross- trained teacher to fill in, a member or management will assume the role, as they are best equipped to do so. Management also acknowledges their responsibility to put teachers in environments where they can be successful, which requires additional training and resources. Lastly, the company's policies regarding physical contact with students Will be assessed annually by
ownership to reflect upon if there is a need for change, and management will review these policies and any changes or addendums with the faculty's entire staff.

Description: Based on interviews with staff and documentation reviewed, the center did not ensure behavior guidance was constructive in nature, and age and stage appropriate.

Evidence:
1. Staff #1 stated the following occurred on February 2, 2024: Staff #1 asked child #1 to clean up. Child #1 started to yell and walk away. Staff #1 reached out for child #1?s arm to finish verbally correcting child #1. Staff #1 stated she refused to look at me and staff #1 cupped child #1?s chin with her hand and asked her to engage in the conversation.

Plan of Correction: Once again, although the contact made was not punishment oriented, and we do encourage stu-dents of all ages to participate in conflict resolutio which often requires a level of engagement, including but not limited to, making eye contact with the parties involved to ensure understanding, based upon the student and age range as well as the specifics of the scenario, providing a moment for the
student to decompress and reset is a worth- while endeavor. Teachers who will be cross- trained for various classrooms when a need arise to fill staffing holes will receive training specific to the age group involved and also have the opportunity to shadow the lead teachers in those classroom environments. Management acknowl-edges their role in the success of each classroom and
must put teachers in environments where the have the knowledge and resources to facilitate a positive environment for all of its students. In a situation where this is not feasible, a member of management will step in to fill the void accordingly.
