Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. The statutory requirement can be found online at https://law.lis.virginia.gov/vacode/title22.1/chapter14.1/section22.1-289.057/.

Resources are now available for providers on the "What's New" webpage on the ChildCareVA website at https://www.childcare.virginia.gov/providers/what-s-new.

Provided consultation on the following:
8VAC20-780-350B4 and B5 The ratio for 3 year olds up to school age eligible children is 1 staff member per 10 children. The definition of ?school age? means that children are eligible to attend public school, age 5 or older by September 30 of that same year. Four and five year olds are considered school age during the summer if the children will be entering Kindergarten that year.
8VAC20-780-500.1a The diapering area should have a sink with running water.

The physical plant, outdoor playground area, programming, attendance, menus, 3 staff records, 3 children?s records, 1 medication with corresponding authorization records, 1 allergy care plans, emergency drills, 7 injury reports, emergency supplies, and policies were reviewed. Children were observed participating in free play, board games, watching television and outside play. There was an adequate number of staff present with current certification in Medication Administration Training (MAT), CPR and First Aid, and Daily Health Observation (DHO) training. Violations:
Standard #: 8VAC20-780-80-A
Description: (Repeat Violation) Based on review of the written attendance record and interview with staff, the center did not ensure they maintained a written record of daily attendance for each group of children documenting the arrival and departure of each child in care as it occurs.

Evidence:
1)During inspection on the playground where the Threes and Fours classrooms were playing, there were 19 children present, but the written record reflected there were 22 children present.
2)During inspection in the Toddler classroom, the written record reflected no documentation of departure for the month of May 2024.

Plan of Correction: The center keeps a main record book for the entire center and each classroom has a record book we know who is in the center in each classroom daily. The teacher had both record books with her at the time. The children had been separated to keep the ratios correct, each staff member had a sheet of who9 was in their class at that time. The toddler teacher writes each child in every morning and will highlight the child's name as he or she leaves for the day. She will now write a time-out.

Standard #: 8VAC20-780-280-B
Description: Based on observation, the center did not ensure that hazardous substances were kept in a locked place using a safe locking method that prevents access by children.

Evidence:
1)During inspection in the kitchen directly off the front hallway and where children have access, 1 container of bleach containing a label that stated ?Keep out of Reach of Children? and the word ?Warning? were stored in the open area under the sink in an unlocked area.
2)In the restroom between the Threes and Fours classroom where the door was open, 1 container of antibacterial wipes containing a label that stated ?Keep out of Reach of Children? and the word ?Warning? on the label was stored under the sink in an unlocked cabinet. In the same cabinet there was also an air freshener containing a label that stated ?Keep out of Reach of Children? and the word ?Caution? on the label.
3)In the closet directly off the infant classroom where the door was unlocked, 3 containers of disinfectant wipes and a multi-purpose cleaner containing labels that stated ?Keep out of Reach of Children? and the word ?Caution? on the labels were stored on an open shelf. In the same closet was 1 container of bleach containing a label that stated ?Keep out of Reach of Children? and the word ?Warning? was stored on the open shelf.

Plan of Correction: The substances were immediately removed and locked up.

The substance was removed and locked in a closet immediately, staff has been instructed it must remain in the locked closet at all times after use.

The infant room has been instructed to keep the back closet door locked after each use. (infant children can not reach the door handle to open the closet door)

Standard #: 8VAC20-780-330-B
Description: (Repeat Violation) Based on observation and inspection of the playground, the licensee did not to ensure that the required resilient surfacing surrounding playground equipment with moving parts or climbing apparatus created a sufficient fall zone.

1)The Large playground has a merry-go-round with bikes that is 26 inches in height with shredded rubber measuring less than 1 inch in depth measured on the back side of the equipment. The required depth of shredded rubber in this area should be 6 inches.
2)The Large playground has a platform on the back side of the large play structure that is 42 inches in height with shredded rubber measuring at 3 inches on the left side under the platform instead of the required 6 inches of shredded rubber.
3)The Toddler playground has a slide that is 23 inches in height with shredded rubber measuring less than 1 inch at the bottom instead of the required 6 inches of shredded rubber.
4)The Toddler playground has a slide that is 23 inches in height that is placed 42 inches from the side of the building instead of the required 6 foot fall zone.

Plan of Correction: Playground surfacing has been purchased for the center and is at the center. Management has hired someone to spread the surfacing through out the playground, we did not have the task completed before the inspection. The surfacing will be placed and the merry-go-round is being removed due to the amount of surfacing will not allow the equipment to move. The toddler playground will have more surfacing placed around the equipment.

Standard #: 8VAC20-780-340-F
Description: (Repeat Violation) Based on observation, the center did not ensure that children under 10 years of age always be within actual sight and sound supervision of staff.

Evidence:
During inspection while the Threes and Fours classrooms were on the playground, Child #1 left the playground and went inside the building without a staff member. Staff did not escort the child into the building to maintain sight and sound supervision and staff did not notice the child was missing until the child returned to the group on their own.

Plan of Correction: Staff was taking care of a situation on the playground and the child ran in to use the restroom. The staff had a talk with the student about safety and to please ask before coming in to the restroom and a locked has been placed on the outside door.

Standard #: 8VAC20-780-560-G
Description: (Repeat Violation) Based on observation, the center did not ensure that food brought from home was clearly dated and labeled in a way that identifies the owner.

Evidence: In the Infant classroom, there were 14 containers of food from home that were stored on a shelf that did not have a child?s name on them clearly identifying the owner.

Plan of Correction: The infant room staff had the food placed in front of labeled cubbies. The baby food was labeled and placed in each child's cubby.
