Standard #: 8VAC20-780-40-E
Description: Based on review of documentation and interview, the center did not ensure that the center?s activities, services, and facilities were maintained in compliance with standards and the center?s own policies and procedures that are required by these standards.
Evidence:
1. On October 7, 2022, Staff #1 (van driver) arrived at the center with school age children from local elementary school at approximately 4:30pm.
2. Staff #1 confirmed Child A (six years old) was left on the van for approximately five minutes after failing to complete the name to face roll call.
3. A member of management stated staff are required to complete a name to face roll call as children exit the vehicles.

Plan of Correction: Staff #1 - Van Driver was immediately terminated from employment for not following center protocol and not making management staff aware of the situation. Additional protocol added to van drop-off and pick-up procedures. A rider was added to van runs who will ride in the back of the vehicles to ensure that all children disembark. As an additional fail-safe - upon arrival to center from schools, a management team member will greet the vehicles and complete an additional name -to-face roll call secondary to driver. Once the vehicle is parked, the driver shall complete an additional sweep of the vehicle. Management team member will then escort children to respective classrooms. All staff (not just drivers) were retrained by a risk management specialist in passenger safety. All staff were trained in new protocol for name to face roll call for drop-off and pick-up. The child has remained enrolled at the facility.

Description: Based on review of documentation and interview, the center did not always provide care and protection to a child they were supervising.
Evidence:
1. On October 7, 2022, it was determined Staff #1 (van driver) left Child A (six years old) alone on a van in the center?s parking lot for approximately five minutes.
2. The average temperature on October 7, 2022, between 4:00pm and 5:00pm was 78 degrees Fahrenheit according to wunderground.com.

Plan of Correction: Two name-to-face roll checks will be completed prior to children entering the building. The rider will be stationed in the last seat of vehicles. They will complete a sweep of the vehicle prior to disembarking. A secondary physical check will be completed on each vehicle by the driver prior to leaving the vehicle.

Description: Based on review of documentation and interview, the center did not ensure children under 10 years of age were always within actual sight and sound supervision of staff.
Evidence:
1. On October 7, 2022, it was determined Staff #1 (van driver) left Child A (six years of age) alone on the center?s van for approximately five minutes.
2. At approximately 4:35pm the parent of Child A and Staff #1 found Child A alone, asleep in a car seat on the van.

Plan of Correction: Staff #1 was terminated immediately. All car seats were moved to front seats of all center vehicles in the event a child falls asleep during transport. A rider was assigned to ride in the back of center vehicles to ensure no child is left behind. The child remained enrolled.

Standard #: 8VAC20-780-580-K
Description: Based on review of documentation and interview, the center did not verify all children have been removed from the vehicle at the conclusion of any trip.

Evidence:
1. On October 7, 2022, Staff #1 (van driver) arrived at the center with school age children from local elementary school at approximately 4:30pm.
2. Staff #1 walked with the children from the van into the classroom.
3. At approximately 4:35pm a parent of Child A (six years old) arrived at the center to pick up [Child A]. The parent of Child A and Staff #1 did not see [Child A] in the classroom. Staff #1 realized [Child A] must have been left on the van.
4. The parent of Child A and Staff #1 found Child A asleep in a car seat. The parent of Child A removed the child from the van and left with Child A.
