Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. The statutory requirement can be found online at https://law.lis.virginia.gov/vacode/title22.1/chapter14.1/section22.1-289.057/.
Resources are now available for providers on the "What's New" webpage on the ChildCareVA website at https://www.childcare.virginia.gov/providers/what-s-new.

Areas of non-compliance are identified in the Violation Notice. Please submit your plan of correction within 5 business days for it to be included on the website. Thank you for your cooperation during this inspection. If you have any questions regarding this inspection, contact kristy.atanackovic@doe.virginia.gov.

Violations:
Standard #: 8VAC20-800-430-A
Description: Based on observation and interview it was determined the provider did not ensure children under two years of age and children over two years of age who are not developmentally ready to climb or descend stairs without supervision shall not have access to stairs.

Evidence:
1. The stairway leading to the upstair bedrooms did not have a gate that prevented access to children in care.

2. The stairs leading to the dining room from the living room area did not have a gate that prevented access to children in care.

3. The child in care on the day of the inspection was under two years of age.

4. Child #1's DOB is 6/2/2023 and Child #2's DOB is 9/22/2022

Plan of Correction: Due to the areas being painted, the gates were removed. They were replaced after the children had lunch.
