Comments:
An investigation was initiated from 10:30 am - 12:45 pm in conjunction with a renewal inspection to investigate a complaint received by the department involving behavioral guidance, forbidden actions, and procedures for emergencies. Interviews were conducted, digital documentation, written documentation, child records, and staff records were reviewed. The complaint regarding behavioral guidance, forbidden actions, and procedures for emergencies is determined to be valid.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Standard #: 8VAC20-780-400-B
Complaint related: Yes
Description: Based on interviews it was determined that not all behavioral guidance was constructive in nature and age and stage appropriate. Evidence: It was reported that on 01/17/2024 from around 4:30 pm - 5:00 pm child A (age 2) was displaying behaviors such as crying, screaming and hitting and scratching other children. Staff attempted to redirect child A by giving them toys but the child began to continue with crying and hitting or scratching anyone that came into contact with the them. Staff A then placed the child in time-out in a chair by the classroom door for more than ten minutes. The child was then roughly moved by the right arm by staff A from the chair to a carpet area next to a toy shelf where the child continued to cry and scream. Staff A did not attempt to call management for help with child A. Management was later notified of the situation by the parent of child A who had been watching the interaction on camera.

Plan of Correction: Staff was trained using CCEI on how to manage classroom stress,
understanding child behaviors, and foundations of positive guidance (SOC 102 completed 2/8/2024, GUI101 completed 2/8/2024, GUI106 completed 2/9/2024)

Complaint related: Yes
Description: Based on interviews and review of digital documentation it was determined that staff engaged in a forbidden action of rough handling a child. Evidence: 1. Staff A reported that on 01/17/2024 at around 4:30 pm that Child A (Age 2) was in time out in a chair by the door. Child A was moved by the right arm and carried by Staff A from the timeout chair to the carpet area next to the toy shelf by the right arm.
2. Staff A confirmed that the child was roughly placed on the carpet when shown a photo of the incident.

Plan of Correction: The teacher was immediately removed from the classroom. The teacher received a written documentation of final warning. The teacher was required to attend mandatory CCEI training on classroom management, understanding child behaviors, and foundations of positive guidance (GUI101 completed 2/8/2024, GUI103 completed 2/9/2024, GUI106
completed 2/9/2024).

Complaint related: Yes
Description: Based on interviews it was determined that a written record of children's injuries was not always documented as required. Evidence: on 12/19/2023 child B (18 months) sustained an injury to their forehead. Administration informed child B's parent of the injury via telephone and sent the parent a picture of the injury however, an injury report was not written or provided to the parent of child B.

Plan of Correction: Staff and management will properly document any serious or minor injuries the day of the incident. Management will make copies of all injury reports before giving them to families.
