22.1 BACKGROUND CHECKS CODE; CARBON MONOXIDE

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced renewal inspection was conducted on July 9, 2024 from approximately 9:54 am to 11:15 am. Two staff were present with eight children. Children were observed eating a morning snack, playing outside and doing indoor activities. Licensing Inspector reviewed standards related to administration, physical plant, daily activities, nutrition, recordkeeping and emergency supplies. Four staff and five child records were reviewed. Violations found are noted on the violation notice.

Description: Based on review, facility did not ensure 1 of 5 immunization is signed by a physician, designee or official of the local health department.

Evidence: The record for child #1 (start date 11/8/2023) had an immunization record that is not signed by a physician, designee or health department official.

Description: Based on review, facility did not ensure staff have a negative tuberculosis screening or testing dated within 30 days before beginning employment.

play equipment that is climbing or has moving parts on the outside play area.

Evidence: There is approximately 4" depth of resilient surfacing along the side of the teeter totter and plastic slide/house on the playground. There should be at least 6" depth of resilient surfacing in these areas.
