8VAC20-780-330A Playgrounds should be designed to protect children from hazards. The center should have a policy in place to protect children from hazards related to tree climbing and falls. Specifics should be added to the playground safety policy to ensure that the activity is well monitored, staff are nearby to intervene as necessary and that children are encouraged to learn 'how to' be safe while climbing.

Comments:
An unannounced monitoring inspection was conducted on 06/25/2024 from 9:35am to 10:10am as the result of an injury reported on the playground. Interviews were conducted, documentation was reviewed, and the playground was observed. There was 1 violation cited as the result of the inspection. Areas of non-compliance are identified in the Violation Notice.

Violations:
Standard #: 8VAC20-780-270-A
Description: Based on observation and staff interview, the center failed to ensure that all areas and equipment of the center, inside and outside, were maintained in a clean, safe, and operable condition including but not limited to protrusions or components that could entangle clothing or snag skin.
Evidence:
1)On 6/11/24, Child #1 (age 4) was climbing a tree on the lower area of the front playground. Child #1 fell from a branch approximately 78 inches from the ground and the hood of the child?s sweater got caught on a protruding branch measuring approximately 6 inches long and 1 inch thick that was 64 inches from the ground. The child was suspended in the air, hanging from the sweater hood, for approximately 3 seconds until a staff member standing approximately 8 feet away was able to assist the child to safety. Child #1 sustained a scrape along with swelling and bruising on the front and sides of their neck.
2)There are 4 additional branches approximately 7 inches, 12 inches, 17 inches and 20 inches protruding from the same tree on the lower area of the front playground that are a risk for impalement or snagging a child?s skin as children climb this tree.
3)There is a small tree at the upper area of the front playground that has 3 branches protruding approximately 2 inches, 3 inches and 11 inches in length that are a risk for impalement or snagging a child?s skin as children climb this tree.

Plan of Correction: All of the cited branches will be removed.
