63.2(17) License & Registration Procedures

Comments:
An unannounced monitoring inspection was conducted on October 24, 2019 from approximately 10:15 am-1:15 pm. Upon arrival to the center there were 53 children present with eight staff members. Additional staff were on site for administrative and support purposes. Ten classrooms, restrooms, a library, two welcome rooms, and the outdoor playground were inspected. Thirteen staff records were reviewed. The children were observed doing a variety of activities to include but not limited to playing in centers, during circle time, doing arts and crafts, worksheets and during dismissal from the program. The center does not offer transportation.

Violations:
Standard #: 22VAC40-191-40-D-2
Description: Based on record review, in seven of 13 staff records reviewed, the center did not ensure that staff complete a sworn statement or affirmation prior to employment and/or have a Search of the Central Registry within 30 days of employment.

Evidence:

1. There was no documentation of Central Registry Findings for the following staff members:
Staff #1-(date of hire 9/2019); Staff #6-(date of hire 9/2019); Staff #8-(date of hire 9/2019); Staff #9-(date of hire 8/2017); and Staff #13-(date of hire 9/2014)

2. There was no documentation of a sworn statement or a Central Registry Finding for the following staff members:
Staff #2-(date of hire 9/2018) and Staff #3-(date of hire 9/2019)

Plan of Correction: The sworn statements for Staff #2 and Staff #3 were completed during the inspection. We will obtain the correct documentation for the Central Registry results within 24 hours and provide evidence to the licensing inspector tomorrow.

Standard #: 63.2(17)-1716-A
Description: Based on observation and staff interviews, the center did not post that is exempt from licensure in a visible location on the premises.

Evidence: The Director and Assistant Director confirmed that the center had not posted that the fact that it is exempt from licensure in a visible location on the premises.

Plan of Correction: We will post this announcement in an upstairs and downstairs location.

Standard #: 63.2(17)-1720.1-A
Description: Based on record review, in three of 13 staff records reviewed, the center did not ensure that staff shall undergo a repeat background check every five years.

Evidence: The Director and Assistant Director confirmed that the following staff members did not have a repeat Central Registry finding every five years:
Staff #10-(date of hire 8/2013)-Central Registry finding dated 12/02/09
Staff #11-(date of hire 9/2007)-Central Registry finding dated 12/20/07
Staff #12-(date of hire 9/2011)-Central Registry finding dated 10/21/09

Plan of Correction: We will obtain the correct documentation for the Central Registry results within 24 hours and provide evidence to the licensing inspector tomorrow.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review, in three of 13 staff records reviewed, the center did not obtain a copy of the results of a search of the central registry maintained pursuant to ? 63.2-1515 and any child abuse and neglect registry or equivalent registry maintained by any other state in which the individual has resided in the preceding five years.

Evidence: The Director and Assistant Director confirmed that out of state child abuse and neglect searches had not been requested for the following staff members who indicated living outside of the state of Virginia within the last five years:

1. Staff #1-(date of hire 9/2019) indicated living in three different states within the last five years

2. Staff #6 and Staff #8 (dates of hire 9/2019) indicated living in one state within the last five years

Plan of Correction: We will reach out to the appropriate states to start the process of verifying their record.
