63.2(17) License & Registration Procedures

Comments:
An unannounced monitoring inspection was conducted on 8/28/19 from 11:00 am until 2:00 pm to review the religious exempt requirements. At the time of the inspection 36 children were present with nine staff. The sample size consisted of five children's record and five staff's records. Children and staff were observed during indoor and outdoor play, educational lesson, lunch preparations, hand washing, bathroom break, lunch, nap, diapering, transitioning and behavioral guidance. Violations were found during this inspection and are documented on the violation notice.

Violations:
Standard #: 63.2(17)-1716-A
Description: Based on observation and interview, the center failed to post the fact that the program is exempt from licensure in a visible location and failed to disclose in writing to the parents or guardians of the children in the center the qualifications of personnel.

Evidence:

1. During the tour of the center a posting was not seen stating the center is exempt from licensure.
2. The director stated they do not have the exemption statement posted in a place everyone can see.
3. The parent handbook was reviewed and under the section labeled "Qualifications of Personnel" it states staff position descriptions are posted for your review. During the tour there were no staff position descriptions posted.
4. The director stated they no longer have them posted.

Plan of Correction: A document will be posted in a visible location regarding the center's religious exempt status and the parent handbook will be updated to include information regarding the qualifications of personnel.

Standard #: 63.2(17)-1716-A-6
Description: Based on interview, the center failed to provide a written disclosure to parents and guardians of the children in the center advising information regarding the food service for all children.

Evidence:

1. The parent handbook contained a general statement regarding food service stating: The center provides a combination of nutritious snacks and lunches.
2. During the inspection children under two were observed eating food brought from home.
3. The director stated they do not provide food for children under two and the parent handbook does not state this.

Plan of Correction: The parent handbook will be updated to state children under two must have snacks and lunches brought from home.

Standard #: 63.2(17)-1716-A-9
Description: Based on observation and interview, the center failed to ensure safe sleep guidelines recommended by the American Academy of Pediatrics which advises babies should sleep on their backs on a flat surface free of blankets, pillows, or other soft items until the age of 1 to reduce the risk of SIDS.

Evidence:

1. At the time of the inspection five infants were present under the age of 12 months. All five had blankets in their cribs.
2. Staff stated they do allow infants under 12 months to sleep with blankets.

Plan of Correction: The blankets were immediately taken out of the cribs. The document offered by DSS regarding safe sleep was printed out and given to staff in the infant room to review and share with parents. All future staff that work in the infant room will be trained using the document provided by DSS.

Standard #: 63.2(17)-1716-B-4
Description: Based on record review and interview, the center failed to implement a procedure to ensure all children in the center are in compliance with the provisions regarding immunization of children against certain diseases.

Evidence:

1. The records of five children were reviewed. Child 1's date of birth is 3/24/17 and the immunization record is dated 4/11/18. Child 4's date of birth is 8/19/18 and the immunization record is dated 10/11/18.
2. The director stated they require documentation of current immunizations be provided prior to the first date of attendance and every six months until age two.

Plan of Correction: The parents of child 1 and child 4 will be asked to provide current immunization records. In the future the director will develop a system to ensure immunization records are updated.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review and interview, the center failed to ensure a request for an out-of-state child abuse and neglect search was completed by the end of the 30 days of employment for staff who have resided outside of VA within the past five years from the date of employment.

Evidence:

1. Five staff records were reviewed. Staff 3's start date was documented as 10/29/18. Staff 3 documented on the sworn statement on 10/29/18 that she lived in TX within the last five years. The record did not contain documentation of a child abuse and neglect search being completed for TX.
2. The director stated she did not complete a child abuse and neglect search for TX for staff 3.

Plan of Correction: A child abuse and neglect search will be completed and mailed within five days for staff 3. In the future a child abuse and neglect search will be completed for all new staff that have lived in another state within the last five years. The paperwork will be completed and mailed prior to 30th day of employment.
