Comments:
An unannounced monitoring inspection was initiated on May 10, 2024, in response to a self-reported incident. The inspector and a local agency representative were on-site from 10:30 am until 12:59 pm. The inspection was completed on May 30, 2024. The areas of concern were staffing and supervision, and special care provisions and emergencies.

Information gathered during the inspection determined noncompliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s). 2) measures to prevent the noncompliance from occurring again; and 3) person (s) responsible for implementing each step and/or monitoring any preventive measure(s). Please identify staff in the plan of correction by position title and not by name.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on interviews and review of documentation, the licensee did not ensure that the center's activities were maintained in compliance with these standards and the center's own policies and procedures that are required by these standards.

Evidence:
1. Staff#1, #2, #3, and #4 confirmed in interviews that the center?s policy regarding supervision was not followed on May 8, 2024, during outdoor play. While in the care of Staff#1 and Staff#2 at the center, Child#1 (age 2) left the center unsupervised. Staff speculated that the child left from the playground gate. The child was returned to the center by two men from the community who were unknown by the child or the center?s staff.

2. The center?s policy documentation revealed, adequate supervision means that staff members interact with the children while moving about the indoor and outdoor area, and able to hear and see children at all times.

3. The center?s formal disciplinary memo for Staff#1, and Staff#2 responsible for supervising Child#1 stated, ?This is an official memo to address violation/s of the company?s policy. On the date below (05/08/2024), you failed to perform your required job functions by not providing adequate supervision?.

Plan of Correction: Both staff #1 and #2 received additional training on supervision through the CCEI training portal. Both staff have reviewed and signed the supervision policy for playground supervision on May 9, 2024.

Standard #: 8VAC20-780-340-A
Description: Based on interviews with staff and collaterals, and review of documentation, the licensee did not ensure when staff are supervising children, they shall always ensure their care, protection, and guidance. Child#1 (age 2) left the playground while under the supervision of the center staff, and staff was unaware Child#1 was missing from care until two men from the community returned the child.

Evidence:
1.Collateral witness reported driving in vehicle on Route 5 at approximately 3:37 pm on May 8, 2024, when Child#1 was seen on the road running towards ongoing traffic. Another vehicle braked in front of them, then traffic was stopped by collateral to help two men catch Child#1 to get the child out of the road. The two men took Child#1 up the hill to the childcare playground.

2. Staff#1 revealed on May 8, 2024, the two?s group was taken outside to the playground at 3:23 pm by two staff with a total of six children present. Staff#1 stated while watching the other children, Child#1 was not seen by the staff present on the playground area. Child#1 was returned to the center at the end of the gate by two men. The two men were not affiliated with the center and were unknown to the child.

3. Staff#2 revealed the incident occurred at approximately 3:45 pm on the two?s playground with two staff and six children present. Staff#2 disclosed Staff#1 acknowledged Child#1 was not found on playground and asked where Child#1 was. Staff#2 stated they searched approximately a half a minute before they saw two men walking Child#1 to them.

4.Staff#3 revealed the two?s group was signed out to go to the playground at 3:23 pm on May 8, 2024.

5. Staff#4 confirmed being informed of the incident involving Child#1 on the playground and reported Child#1?s parent was notified of the details of the incident at pick up.

6. An injury- incident report documented ?Child#1 left the play yard without our knowledge and was brought back by two men?.

Plan of Correction: B. Both staff #1 and #2 received additional training on supervision through the CCEI training portal. Both staff have reviewed and signed the supervision policy for playground supervision on May 9, 2024.

Standard #: 8VAC20-780-340-F
Description: Based on interviews and documentation, the licensee did not ensure children under 10 years of age always shall be within actual sight and sound supervision of staff.

Evidence:
1. Collateral witness reported Child#1 (age 2) was observed alone in the road without an adult in sight on May 8, 2024.

2. Staff#1, #2, #3, and #4 confirmed the incident that occurred at the center on May 8, 2024, involving Child#1 (age 2) being unsupervised by staff. It was speculated by staff that the child left from the playground gate and was returned by two men from the community approximately 3:45 pm.

3. Written statements from Staff#1, #2, #3, and #4 completed on May 8, 2024, confirmed the incident involving Child#1 (age 2) being unsupervised by Staff#1 and Staff#2.

4. Administrative staff revealed Child#1 (age 2) got out of the center?s two?s playground area and was returned by two men unaffiliated with the center on May 8, 2024.

5. Collateral revealed it was reported Child#1 (age 2) was unaccounted for approximately 20 minutes on May 8, 2024 by the center and the staff were unaware until the child was returned by two men unknown by the center.

Plan of Correction: On May 9, 2024, a maintenance ticket was entered into the maintenance system to remove the gate from the two-year-old playground, leading to an area not fenced in on the property. The gate will be replaced with additional chain link fencing on June 20, 2024. Until the gate is removed the two-year-old classroom will not be using this playground. Both staff members present during the incident have received additional training in supervision. One staff member has been placed in an older age group in a supporting teaching role.
