Comments:
The licensing inspector initiated and concluded an unannounced subsidy complaint inspection on July 19, 2023 in response to a complaint received by the department on July 13, 2023 for allegations regarding forbidden action and behavioral guidance. On Wednesday, July 19, 2023, the inspector was on site from 11:10am until approximately 2:00pm. Interviews were conducted, observations were made at the center, and documentation was reviewed.

Based on the information gathered during the investigation, the preponderance of evidence supports the allegation, therefore the complaint is determined to be valid. Violations were documented on the violation notice issued to the program.

Please complete the 'plan of correction' and `date to be corrected' for each violation cited on the violation notice and return it to me within five business days from today. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Violations:
Standard #: 8VAC20-790-700-A
Description: Based on a review of documentation and interviews, the vendor did not ensure that behavioral guidance shall be constructive in nature and age and stage appropriate and shall be intended to redirect children to appropriate behavior and resolve conflicts.

Evidence: 1) During interview, Staff #1 reported that on 7/11/23, she swatted a child's hand when the child tried to reach for her cup. Staff #1 reported it was a "natural instinct," but she was trying to redirect him.

2) In a written Incident Report dated 7/11/23, Staff #1 stated: "[Child #1] was reaching for my water cup and I swatted his hand before he touched it. I then told him to swat my hand back."

Plan of Correction: Per the Vendor: "1) Steps to correct noncompliance with the standards: The teacher will review training on behavioral guidance and forbidden actions (Standard 8VAC20-790). The teacher will also be asked to investigate more creative ways to positively redirect negative behavior patterns.

2) Measures to prevent the compliance from occurring again: The teacher will make sure that personal items are placed out of the students' reach. The teacher will be encouraged to continue to journal positive and negative interactions in the classroom. Throughout the week, the teacher will give the students the opportunity to talk about sharing, personal space, and what happens when our friends tell us "No." A meeting with the teacher, the child's parent, and the Director will be scheduled to discuss further ways to incorporate these lessons at home.

3) Person responsible for implementing each step and/or monitoring the preventive measures: The director will set the due date for each training and notate when complete."
