Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documentation review, interviews and a virtual tour of the program .

A code compliance inspection was initiated on October 5, 2021 and concluded on October 20, 2021. The in-charge person was contacted by telephone and a virtual inspection was conducted. There were 20 children present, ranging in ages from two to five years, with five staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, and medication. A total of three children?s records and three staff records were reviewed.

Information gathered during the inspection determined non-compliances with applicable code sections and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-191-40-D-2
Description: Based on review of three staff records and interview, the center did not ensure documentation of required background checks for three staff members within 30 days of the individual's beginning date of employment or service.

Evidence:
1. The records for Staff #1 (hire date 01/04/2021), Staff #2 (hire date 08/02/2021) and Staff #3 (hire date 06/21/2021) did not contain the results of central registry search.
2. A member of management was unable to provide documentation of the results of a completed central registry search.
3. A member of management stated the previous State of Virginia Criminal Record Search was completed mistakenly instead of the central registry search.

Plan of Correction: The form was given to the staff on 10/20/2021 and will be completed and sent to the correct agency by the end of the week.

Standard #: 63.2(17)-1716-A-5-d
Description: Based on documentation review and interviews, the center did not ensure that Chapter 10 of Title 46.2 of the Code of Virginia regarding child restraint devices was followed during transportation of children.

Evidence:
A member of management stated during the virtual inspection, children younger than eight years of age were being transported on a van to and from public school. On 10/20/2021, another member of management stated the center borrowed two vans for transportation and the booster seats were left the original vans.

Plan of Correction: We used the other van for a few days while our vans were being repaired. We will make sure all children under the age of eight will always ride in the booster seats. This information will be reviewed with all staff immediately and monitored to make sure this requirement is followed at all times.
