8VAC20-790 Subsidy Program Vendor Requirements for Child Day Centers

Comments:
A subsidy health and safety inspection were initiated on 10/30/23 and concluded on 10/30/23. There were 43 children present, ranging in ages from two to five, with 12 staff. The Inspector reviewed five child?s records and five staff?s records. The physical plant was observed, and the provider was interviewed regarding policies and procedures.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 8VAC20-790-520-F
Description: Based on observation and interview, the center failed to maintain, in a way that is accessible to all staff who work with children, a current written list of all children's allergies, sensitivities, and dietary restrictions that is dated and kept confidential in each room or area where children are present.

Evidence:

1. Staff 3 stated two children in the class had food allergies. The food allergy list posted in the classroom only contained the name of one child.
2. The assistant director verified only one child's name was on the posted list in the classroom.
3. Staff 4 stated one child has a food allergy in the class. There was no food allergy list in the classroom.

Plan of Correction: The list were updated in the two classrooms. From now on the administration will ensure all food allergies, sensitivities and dietary restrictions are dated and posted in each classroom the child is in.

Standard #: 8VAC20-790-550-2-a
Description: (REPEAT VIOLATIONS) on record review and interview, the center failed to ensure the results of the fingerprint-based national criminal background check were obtained prior to first date of employment.

Evidence:

1. The record for staff 1 documented the employment date as 2/6/23. The fingerprint results were dated 2/21/23.
2. The assistant director verified the dates.

Plan of Correction: No staff will begin employment until fingerprint results have been received.

Standard #: 8VAC20-790-640-A
Description: Based on observation, the center failed to ensure all hazardous substances were kept in a locked place.

Evidence:

In the 4's classroom (Turtles) a spray bottle of Clorox disinfectant and a spray bottle of Windex were on a low shelf accessible to children.

Plan of Correction: The hazardous substances will be moved to the locked closet. Staff will be reminded to ensure all hazardous substances are kept in a locked location when not in use.
