Comments:

This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A complaint inspection was initiated on April 30, 2021 and concluded on May 14, 2021. A complaint incident was received by the department regarding allegations in the areas of building maintenance, ratios, topical skin products, medication administration, and diapering. The director was contacted by telephone to initiate the investigation. Observations were made, interviews were conducted, and documentation was reviewed. The preponderance of the evidence gathered during the investigation supports one or more of the allegations and the complaint is determined valid. Violations that were not a part of the original complaint are also listed on the violation notice. Please complete the "plan of correction" and "date to be corrected" for each violation cited on the violation notice and return it to the licensing office within 5 business days. Your plan of correction should contain 1) steps to correct the non-compliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s). Description:	Based on observations, the center did not ensure that areas and equipment shall be maintained in a celan, safe, and operable condition. Evidence: 1. On 4/30/2021 the licensing inspector observed an outlet plate in the two year old classroom that was not attached to the wall. The outlet was located on the lower wall, within reach of children. 2. A toybox on the playground was observed to have a broken plastic lid which was within reach of children.

Description:	Based on observations, the center did not ensure that hazardous substances shall be kept in a locked place. Evidence: 1. On 4/30/2021 the licensing inspector observed Air Wick air freshener spray and an antibacterial spray cleaner stored on the top of a high mirror in the bathroom. In the three year old classroom, Clorox wipes and Lysol spray were observed in an unlocked closet. 2. On 5/14/2021 the licensing inspector observed multiple cans of Microban sanitizing spray in an unlocked closet in the office.

Description:	Based on observations, the center did not ensure that the diapering area shall be provided with the required elements. Evidence: 1. On 4/30/21 the licensing inspector observed the diapering area in the girls' bathroom had a cloth cover on the changing pad. The changing pad had several tears, exposing foam filling. 2. On 5/14/21 the licensing inspector observed the diapering area in the two year old classroom had a cloth cover on the changing pad. The diapering areas shall be provided with a nonabsorbent surface.

Description:	Based on observations, documentation review, and staff interviews; the center did not ensure that medication shall be given to a child only with written authorization from the parent. Evidence: 1. Staff interviewed stated that the center has Children's Tylenol and Benadryl available in the office for children to use as needed, as long as prior permission is obtained from the parent by phone. 2. Staff interviewed reported having observed Tylenol being administered to children at the center after only verbal authorization was obtained from a parent. 3. On 5/14/21, administrative staff reported that Children's Tylenol and Benadryl have been administered to an unknown number of children as needed, with only verbal authorization from a parent. 4. On 5/14/21, the licensing inspector observed a bottle of Children's Tylenol, a bottle of Benadryl, and a bottle of children's liquid acetaminophen located in the office closet. Each was labeled "BHC" in marker. 5. Administrative staff reported that the medications labeled "BHC" were desiginated to be used for any child who needed medication, but did not have medications brought in by a parent; and were only used if verbal permission had been obtained first.

Description:	Based on observation, the center did not ensure that all medications shall be kept in a locked place, using a safe locking method that prevents access by children. Evidence: 1. On 5/14/21, the licensing inspector observed two medications, liquid Sudafed and Zarbee's cough syrup, unlocked; and located on the top of a lower cabinet in the office. 2. The licensing inspector observed the following medications in an unlocked closet in the office on 5/14/2021: one bottle of children's liquid acetaminophen, one bottle of Children's liquid Tylenol, one bottle of liquid Benadryl, and one bottle of adult cold and flu liquid medicine.

Description:	Based on an interview with administrative staff, the center did not ensure that a record shall be kept for any medications administered to a child. Evidence: During an interview with the licensing inspector on 5/14/21, two administrative staff members reported that the center had administered medications to an unknown number of children without keeping a record at the center. Each time medication is administered, a record shall be kept to include the child's name, the amount and type of medication, the day and time the medication was administered, the name of the staff member who administered the medication, any adverse reactions, and any medication error.

Description:	Based on observation and a review of documentation, the center did not ensure that when an authorization for a medication expires, if not picked up by a parent within 14 days, the medication shall be disposed of by the center. Evidence: The medication record for Child #1 contained a parent authorization that expired on 3/16/21. The licensing inspector observed the medication was present at the center, and was located on the top of a lower cabinet in the office.

Description:	Based on interviews with staff, the center did not ensure that when diaper cream is used the following requirements shall be met: written parent authorizations will be obtained, product will be labeled with the child's name, and a record for each child will be kept with the dates of use, frequency of application, and any adverse reactions. Evidence: 1. Staff and administrative staff interviewed reported the center had a jar of Desitin diaper cream that could be used by any child, as needed, with verbal permission from a parent. 2. Administrative staff reported that the Desitin used by the center was not labeled for an individual child's use, but was used for multiple children, as needed, with verbal permission by parents. 3. Administrative staff reported no records had been created to document the use of diaper cream for an unknown number of children.
