Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced, on-site monitoring inspection was conducted on June 26, 2024 from 2:30 p.m. to 5:30 p.m. The inspector reviewed compliance in the areas listed above. There were 58 children present and 9 staff. The inspector reviewed 5 children?s records and 3 staff records on-site. This inspection included document review, tour of the facility, interviews, and observations.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-770-60-C-2
Description: Documentation of a completed search of the central registry (CPS check) shall be on file for each staff within the first 30 days of employment. Evidence: Staff 3 (date of employment 1/25/2024) did not have a completed search of the central registry on file. There was no documentation of having submitted the search of the central registry within 7 days of employment as required.

Plan of Correction: Staff will contact the CPS office to check the status of the CPS background check.

Standard #: 8VAC20-780-160-A
Description: Repeat violation. Staff are to obtain documentation of a negative tuberculosis (TB) screening at the time of employment and prior to coming into contact with the children. Staff 3 (date of employment 1/25/2024) did not have documentation of a TB test on file.

Plan of Correction: Staff will submit TB screenings prior to employment.

Description: Repeat violation. Hazardous substances such as cleaning materials, insecticides, and pesticides shall be kept in a locked place using a safe locking method that prevents access by children. There was unlocked sanitizer and Lysol in cabinets above the diapering area in the infant room and the toddler room.

Plan of Correction: Locks will be purchased for the cabinets.

Description: Repeat violation. In groupings of children ages school age eligible to 9 years, the staff to child ratio shall be 1 staff for every 18 children. On 6/26/2024, one staff was alone with 32 children ages 5 years to 12 years for approximately 10 minutes.

Plan of Correction: Appropriate ratios will be maintained at all times.

Standard #: 8VAC20-780-550-G
Description: The center is responsible for maintaining documentation of emergency evacuation, shelter in place, and lockdown drills. The emergency drill log could not be located during today's inspection.

Plan of Correction: Drills will be logged as they are conducted.

Standard #: 8VAC20-780-560-M
Description: No child shall be allowed to drink or eat while walking around. A child in the toddler room was walking around with a sippy cup and eating a cracker.

Plan of Correction: Staff will be reminded to have children sit while eating and drinking.
