22.1 Background Checks Code, Carbon Monoxide

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Provided consultation on the following:
8VAC20-800-500C Outdoor equipment should have a 6 foot perimeter surrounding it to create a sufficient fall zone.

Comments:
An unannounced monitoring inspection was conducted on 05/23/2024 from 9:30am to 10:20am with the Provider. There were 6 children ages 18 months to age 4 years old (11 points) with the Provider. The programming area, attendance, outdoor play area, menus, Provider and Household member records, 5 children?s records, emergency drills, emergency supplies, and policies were reviewed. There were no medications on site. Children were observed participating in singing and math activities. The Provider had a current certification in CPR and First Aid training. Areas of non-compliance are identified in the Violation Notice.

Standard #: 8VAC20-800-780-B
Description: Based on review of 5 child records, the provider did not conduct an annual review of children?s emergency contact information and the parent?s acknowledgment of the review.

Evidence: The record for Child #1, Child #2, Child #3 and Child #4 did not contain documentation of an annual review of the children?s record, nor did the records contain parent acknowledgment of the review.

Description: Based on observation, the provider did not ensure that potentially poisonous substances were stored in an area inaccessible to children.

Evidence:
In the kitchen area where children have access there were several containers of alcohol stored in the mini refrigerator.

Description: Based on observation, the provider did not cover all unused electrical outlets accessible to children under five years of age with child-resistant protective covers.

Evidence:
There was an unused outlet in the children?s bathroom and an unused outlet at the kitchen wall that was uncovered.

Standard #: 8VAC20-800-430-A
Description: Based on observation, the Provider did not ensure that children under two years of age and children over two years of age who are not developmentally ready to climb or descend stairs without supervision shall not have access to stairs.

Evidence: During inspection, there was an unfastened baby gate leaning on the stairs making the stairs accessible to children under 2 years of age.
