Comments:
An onsite code compliance inspection was conducted October 26, 2023. The inspection was initiated at approximately 11:30 AM and concluded at approximately 1:30 PM. There were 26 children present, ranging from six months to five years of age, with six staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, and medication. A total of five children's records and six staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.


Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice, sign and returned it to me within five business days from today. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Standard #: 22.1-289.031-A-4
Description: Based on review of six staff records, the center failed to ensure four staff obtained documentation from a physician that they are free from any disability which would prevent staff from caring for children under staff supervision by the first date of employment and annually thereafter.
Evidence:
1. The records for Staff #3 (Date of Employment 05/20/2023), Staff #4 (Date of Employment 04/28/2023), Staff #5 (Date of Employment 06/12/2023) and Staff #6 (Date of Employment 09/25/2023) did not contain a staff health report stating staff were free from any disability which would prevent staff from caring for children.
2. A member of management confirmed this information during the inspection.

Standard #: 22.1-289.031-A-8
Description: Based on observation, record review and interview, the center failed to ensure a person trained and certified in first aid and cardiopulmonary resuscitation (CPR) was present at any other location in which children attending the child day center are present.
Evidence:
1. The record of Staff #6 (Date of Employment 09/25/2023) did not contain documentation of first aid and CPR.
2. During the inspection, Staff #6 left the center with the bus to pick up children from a local elementary school.
3. No other adults were on the bus with Staff #6.
4. A member of management confirmed Staff #6 did not have current certification in first aid and CPR and would be alone with the children while driving the bus.

Standard #: 22.1-289.031-A-9
Description: Based on observations, the center did not ensure compliance with all safe sleep guidelines recommended by the American Academy of Pediatrics.
Evidence:
1. Infant #1 (six months of age) was observed sleeping on a boppy pillow placed in the crib.
2. The American Academy of Pediatrics states infants need to sleep on their backs on flat non inclined surfaces without soft bedding.

Standard #: 22.1-289.031-B-4
Description: Based on the review of five children's records, the center did not establish and implement procedures ensuring that three children in the center were in compliance with the provisions of ? 32.1-46 regarding the immunization of children against certain diseases.
Evidence:
1.The records for Child #1 (first day of attendance 05/15/2023), Child #2 (first day of attendance 05/15/2023) and Child #5 (first day of attendance 08/23/2021) did not have documentation of immunizations.
2. Child #1, Child #2 and Child #5 were observed in care during the inspection.
3. The Parent Handbook stated proof of immunizations are required prior to attending the center.
4. A member of management confirmed this information while the inspector was on site.

Description: Based on review of six staff records, the center did not ensure that one staff member had a completed search of the central registry within the first 30 days of employment or volunteering.
Evidence:
1. The record for Staff #2 (Date of Employment 06/10/2020) did not contain central registry results.
2. Staff #1was observed working with the children during the inspection.
4. A member of management confirmed this information while the licensing inspector was on site.
