22.1 Background Checks Code, Carbon Monoxide

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Provided consultation on the following:
8VAC20-800-500 When in use for children in care, swing sets should be anchored, s-hooks should be closed and swings should have flexible seats.

Comments:
An unannounced monitoring inspection was conducted on 06/03/2024 from 11:45am to 12:50pm with the Provider. There were 7 children ages 17 months to age 4 years old (16 points) with the Provider and 1 assistants. The programming area, attendance, outdoor playground area, menus, Provider, Assistant and Household member records, 7 children?s records, emergency drills, emergency supplies, and policies were reviewed. Children were observed napping. There Provider had current certification in CPR and First Aid training. Areas of non-compliance are identified in the Violation Notice. Missing background checks must be sent no later than 10 days from the date of inspection.

Violations:
Standard #: 22.1-289.036-A
Description: Based on review of 3 Household member records, the provider did not obtain a central registry background check report every five years from the date of the last check.

Evidence: The record for Household Member #1 and Household Member #2 did not contain documentation that a central registry background check report had been completed every five years from the date of the last check. The last central registry check completed for household member #1 was 4/11/19 and the last central registry check completed for Household member #2 was 12/18/18.

Plan of Correction: I send the forms to VDSS and hopefully will get back in a couple of weeks.

Standard #: 8VAC20-800-430-B
Description: Based on Provider interview, the Provider did not ensure that accordion expansion gates or pressure mounted gates were not used as protective barriers at stair openings.

Evidence: The Provider stated that they use an accordion gate as a barrier to block the 10 stairs leading down to the basement from the playground area.

Plan of Correction: I will fix this issue asap.
