Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced monitoring inspection was conducted on 6/3/2024 from 2:00pm-3:40pm. At the time of entrance, 4 children , ages 2 to 3 years old, for a total of 8 points, were in care with the provider. The sample size consisted of 6 Children?s records and 5 Provider / Household Member records. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition Children were observed during free play and were playing with construction materials and manipulatives as well as props for pretend play. Medication is not being administered to children in care. Children are not routinely transported in a vehicle. Safety measures were reviewed and inspected, to include locks on all doors which access the back yard where an in ground swimming pool is now located. Children play in the front lawn or take a walk to the park that is located just up the block from the home. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Repeat violations were found and are identified within this report.

Description: *** REPEAT VIOLATION***
Based on a review of records and interview, the licensee was unable demonstrate that each child's record is reviewed annually with the child's to ensure that the emergency contact information required in 8VAC20 800 60 B 2 to ensure the information is correct with the parent's signed acknowledgment of the review.
Evidence:
Four children's records were reviewed.
The record for child #3 who enrolled for care 3/21/2022 and the record for child #4 who enrolled for care 2/21/2023 did not contain documentation that the records had been reviewed by the parents and updated for any changes to the emergency information, as applicable, annually.

Plan of Correction: The licensee will review the documented information with the parents of child #3 by the end of the week and obtain any needed changes to the information in writing along with the parents signature indicating that the information in the record is current and up to date.
The record for child #4 was reviewed and updated on the same date as the inspection, 6/3/2024, and emailed to the inspector that evening.

Standard #: 8VAC20-800-100-A
Description: Based on a review of records and interview, the licensee did not always obtain documentation of a physical exam by or under the direction of a physician prior to a child's attendance or within 30 days after the first day of attendance.
Evidence:
Four children's records were reviewed.
The record for child #1 who enrolled 12/4/2023 did not contain documentation of the results of a physical exam.
The licensee was unable to locate the immunization record for child #1 during the inspection.

Plan of Correction: The licensee will discuss the missing documentation with child #1's parent and request that the child's physical results be submitted within 30 days.

Standard #: 8VAC20-800-90-A
Description: Based on a review of records, the licensee di not always obtain documentation that each child has been adequately immunized according to the requirements of ? 32.1-46 A of the Code of Virginia and applicable State Board of Health regulations before they attend.
Evidence:
Four children's records were reviewed.
The record for child #1 who enrolled 12/4/2023 did not contain documentation of immunizations.
The licensee was unable to locate the immunization record for child #1 during the inspection.

Plan of Correction: The licensee will discuss the missing documentation with child #1's parent and request that the current immunization record be submitted within 30 days.

Standard #: 8VAC20-800-180-A
Description: Based on a review of records, the licensee did not obtain for each caregiver and adult household member a current Report of Tuberculosis (TB) Screening form, every two years from the date of the first screening or more frequently as recommended by a physician or the local health department.
Evidence:
Four Provider / Household member records were reviewed.
The record for provider #1 contained the most recent TB screening which was dated 12/5/2021 and was not updated within 2 years from that date.
The record for household member #2 contained the most recent TB screening which was dated 9/15/2021 and was not updated within 2 years from that date.
The licensee confirmed that she did not have documentation of more recent TB screenings for Provider #1 or Household Member #2.

Plan of Correction: The licensee will ensure that she obtains documentation of a current tuberculosis screening for Provider #1 and Household member #2 before the end of the month.
