Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced monitoring inspection was completed on June 20, 2024. The on-site inspection began at 9:50am and ended at 1pm. The inspectors reviewed compliance in the areas listed above. There were 92 children present and 21 staff. The inspector reviewed 10 children?s records and 7 staff records. This inspection included document review, tour of the facility, interviews, and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-A
Description: The center is required to obtain background checks every five years. The most recent criminal background check for Staff #2 was dated August 31, 2018.

Plan of Correction: The center responded with the following: Staff #2 was able to schedule an appointment to have her criminal background check completed. Once obtained, the results will be sent to the licensing inspector and printed for the staff member?s file.

Standard #: 8VAC20-780-270-A
Description: Areas and equipment of the center, inside and outside, shall be maintained in a safe and operable condition. Unsafe conditions shall include splintered and cracked wood. In the toddler playground, the wood parameter of the playground has two areas of splintered and cracked wood that poses as a snagging and/or injury hazard to the children in care.

Plan of Correction: The center responded with the following: The center put in a work order to have the two areas of splintering and cracked wood to be repaired and replaced.

Standard #: 8VAC20-780-280-B
Description: REPEAT VIOLATION.
Hazardous substances such as cleaning materials shall be kept in a locked place using a safe locking method that prevents access by children. A can of disinfectant spray and a bottle of air freshener with warning labels, ?Keep out of reach of children,? were unlocked in the 4 year old classroom.

Plan of Correction: The center responded with the following: The cleaning materials were immediately locked during the time of the inspection. Center will ensure that the cleaning products and all hazardous substances will be locked to prevent access by children.

Standard #: 8VAC20-780-440-G
Description: REPEAT VIOLATION.
Cribs shall be used for children under 12 months of age. There were three children in the infant room over the age of 12 months that were sleeping in cribs.

Plan of Correction: The center responded with the following: The center will call the parents of the three children to let them know that they will transition to rest mats/cots. Should the parents request the child to stay in the crib, they will obtain a letter from their pediatrician and place the letter in the child?s record. Moving forward, children will transition to rest mats/cots after 12 months of age.
