Technical Assistance:
The playground should be placed off limit through signage and caution tape until it is designed to protect children from hazards (the nearby road.) Signage and caution tape is not a permanent solution but a temporary stop gap. Please submit a detailed plan and timeline for the playground to be brought into compliance with the standards.

Potable Water Lead Testing Requirements
The VDOE recently distributed memos to licensed child day programs, certified preschools and religiously exempt child day centers, sharing the requirement to develop and implement a plan to test potable water pursuant to ? 22.1-289.057 of the Code of Virginia. The VDOE will begin determining compliance with this statute effective January 1, 2025. The memos can be found on the VDOE child care website: www.childcare.virginia.gov.

Comments:
An unannounced focused monitoring inspection was conducted from 9:30 - 11:30am with the director. There were 17 children, ranging from 18 months to five years of age, present with four staff supervising. Children were observed eating snack, playing with play doh and painting. Snack served today: graham crackers and apple sauce. Four child records and two staff records were reviewed, along with the emergency drill log, written daily attendance, written allergy list, playground area and the required posted information. Standard #: 8VAC20-780-40-D
Description: Based on observation, the facility failed to post the license in a place conspicuous to the public. Evidence: the license was located on a desk in the office.

Standard #: 8VAC20-780-80-A
Description: Based on review of the written attendance record, and staff interview, it was determined that the facility did not maintain a written record of daily attendance, for each group of children, that documents the arrival and departure of children in care as it occurs. Evidence: there was no written record of attendance for the eight toddlers/two's that were observed eating snack together.

Standard #: 8VAC20-780-330-A
Description: (Repeat Violation) Based on observation, and interviews, the playground is not located and designed to protect children from hazards. Evidence: The playground location is unfenced in the parking lot, with cones as a border, and is in close proximity to a busy three lane road, with a speed limit of approximately 35mph. Staff stated that children use this playground area to ride bikes, play on the slide, play on the spinning playground equipment and play on the yellow climber.

Description: Based on observation, the facility failed to ensure that children?s hands were washed as required. Evidence: The toddlers and two's were observed eating snack together and their hands were not washed afterwards.

Standard #: 8VAC20-780-500-B
Description: (Repeat Violation) Based on observation, and staff interview, the diapering area in the two's classroom did not contain the appropriate (foot operated) disposal system for diapers, as required. Evidence: the foot operated disposal system had a sign on it stating, "soiled linen" and staff stated they use the other trash can, which was not foot operated, to dispose of diapers.
