22.1 Background Checks Code, Carbon Monoxide

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. The statutory requirement can be found online at https://law.lis.virginia.gov/vacode/title22.1/chapter14.1/section22.1-289.057/.

Comments:
An unannounced monitoring inspection was conducted on 05/30/2024 from 10:20am to 11:20am with the Provider. There were 5 children ages 23 months to age 4 years old (11 points) with the Provider. The programming area, attendance, outdoor playground area, menus, Provider and Household member records, 5 children?s records, emergency drills, 1 injury report, emergency supplies, and policies were reviewed. There were no children?s medications onsite. Children were observed participating in free play and television time. The Provider had current certification in CPR and First Aid training. Areas of non-compliance are identified in the Violation Notice.

Please complete the columns for "Plan of Correction" and "Date to be Corrected" for each violation cited on the Violation Notice, and then return a signed and dated copy to the licensing office by 5pm on 6/4/24. Please email me at angela.dudek@doe.virginia.gov with any questions.

Standard #: 8VAC20-800-780-B
Description: Based on review of 5 child records, the provider did not conduct an annual review of children?s emergency contact information and the parent?s acknowledgment of the review.

Evidence: The record for Child #1, Child #2, Child #3, and Child #5 did not contain documentation of an annual review of the children?s emergency contacts, nor did the records contain parent acknowledgment of the review. The last parent review for Child #1 was 1/8/23, the last parent review for Child #2 was 6/17/22, the last parent review for Child #3 was 9/9/22, and the last parent review for Child #5 was 1/1/23.

Plan of Correction: Already spoken with parents. 30 days.

Standard #: 8VAC20-800-90-C
Description: Based on review of 5 child records, the provider did not ensure they obtained documentation of additional immunizations for a child who is not exempt from the immunization requirements once every 6 months for children under the age of two years.


Evidence:
1)The record for Child #1 (age 2) did not contain immunizations once every 6 months for a child under the age of 2 years. The last immunization documentation contained in the record was dated 8/18/23 when the child was 15 months old.
2)The record for Child #2 (age 3) did not contain immunizations once every 6 months for a child under the age of 2 years. The last immunization documentation contained in the record was dated 12/20/21 when the child was 18 months old.
3) The record for Child #3 (age 2) did not contain immunizations once every 6 months for a child under the age of 2 years. The last immunization documentation contained in the record was dated 1/25/23 when the child was 19 months old.

Plan of Correction: Already spoken to parents. Note-shot records are up to date and current just not reprinted within a 6 month date. Work in progress by 7/8.

Standard #: 8VAC20-800-430-B
Description: Based on Provider interview, the Provider did not ensure that accordian expansion gates or pressure mounted gates were not used as protective barriers at stair openings.

Evidence: The Provider stated that they use a pressure mounted gate as a barrier to block the stairs leading up to the deck.

Plan of Correction: Will look into suggested gate options and decide. No date at the time.
