Comments:
An unannounced code compliance inspection for the religiously exempt child day center was conducted on 01/25/2024 and concluded with an electronic record review on 01/30/2024. A total of 24 children, ages 2 years-4 years and 5 staff were present during the inspection. A total of 5 children?s records and 5 staff records, as well as other required documents were reviewed during the inspection. The children were observed during arrival, mealtime, and self-directed activities. The inspector arrived at approximately 8:45 am and departed at approximately 10:30 am.

Information gathered during the inspection determined non-compliance with the Code of Virginia and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 22.1-289.035-A
Description: Based on record review, the center failed to ensure that all employees shall undergo a background check in accordance with the Code of Virginia prior to employment and every five years thereafter.

Evidence:
1. The most recent employment eligibility letter for Staff 1 was dated 09/04/2018. There was no 2023 employment eligibility letter available for review during the inspection.
2. The most recent employment eligibility letter for Staff 3 was dated 08/30/2018. There was no 2023 employment eligibility letter available for review during the inspection.

Plan of Correction: Center will update fingerprint eligibility letter.

Standard #: 22.1-289.035-B-2
Description: Based on record review and staff interviews, the center failed to ensure that no person shall be hired for compensated employment prior to the facility obtaining an employment eligibility letter upon the completion of a fingerprint background check as required by the Code of Virginia.

Evidence:
1. Staff 4 verified that Staff 2 was hired on 01/05/2022. The employee eligibility letter was dated 02/01/2022. The employee eligibility letter was not obtained prior to hire.
2. Staff 4 verified that Staff 4 was hired on 01/07/2020. The employee eligibility letter was dated 02/04/2020. The employee eligibility letter was not obtained prior to hire.
3. Staff 4 verified that Staff 5 was hired on 08/01/2022. The employee eligibility letter was dated 08/22/2022. The employee eligibility letter was not obtained prior to hire.

Plan of Correction: When hiring new staff, the center will obtain fingerprint eligibility letter prior to hire.

Description: Based on record review and staff interviews, the center failed to ensure that an employee must not be employed until the agency has the person?s completed sworn statement or affirmation and to obtain the findings from a search of the central registry within 30 days of employment.

Evidence:

1.Staff 4 verified that Staff 1 was hired on 08/01/2010. No sworn statement for Staff 1 was available for review. There was no findings from a search of the central registry for Staff 1 available for review during the inspection. Staff 4 verified the sworn statement and central registry were not available.
