Comments:
An unannounced inspection was initiated on May 6, 2024, and concluded on June 6, 2024, in response to a complaint received by the licensing office on May 6, 2024, relating to allegations of staffing and supervision and programs. The inspector reviewed four children?s records and one staff record on-site on May 8, 2024. This inspection included document review, tour of the facility, interviews, and observations. The preponderance of evidence gathered during the investigation supports the allegations; therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 6/12/2024. A POC submitted after this date will not appear on the public website.

Description: When staff are supervising children, they shall always ensure their care, protection, and guidance. A child received several injuries while engaged in rough housing with another child while supervised by staff.
1. Child #1 (age 3) and Child #2 (age 4), were wrestling directly in front of Staff #1 on April 23, 2024. A third child in the classroom attempted to get Staff #1?s attention on two separate occasions pointing at the two children wrestling. Staff #1did not respond, and continued to sit and scroll on their personal cell phone.
2. The two children continued to wrestle in another area of the classroom and Staff #1 did not redirect them but continued to stay on their personal cell phone. The children were wrestling for at least 10 minutes. While wrestling, one child received several bite marks and bruises on their back.
3. Staff #1 confirmed that children were wrestling and stated and confirmed that they did not physically intervene to redirect them.
4. Staff #1 confirmed that personal cell phone usage is prohibited, per the center?s policy, and admitted doing ?personal stuff? on their phone while in the role of supervising children.

Plan of Correction: Precious Pearls Policies and procedures have been in place at the time of employment. Staff #1 did not follow Precious Pearls Policies and Procedures, therefore, Staff #1 has been terminated.

Complaint related: Yes
Description: The following actions or threats thereof are forbidden: roughly handling a child and enclosure in a space that the child cannot freely exit himself. Staff engaged in rough handling of a child and the use of a highchair for confinement outside of its intended purpose.
1. On April 23, 2024, Staff #1 lifted Child #1 (age 3) off the ground by the arm to have the child stand up. Staff #1 walked the child across the room holding their arm then pushed Child #1 to another side of the classroom.
2. Staff #1 confirmed grabbing Child #1 to move them to another area of the classroom.
3. On April 23, 2024, Child #3 (age 3) was restrained in a highchair and fell to the floor with the highchair still attached to their body. The child was able to prop themselves upright in the highchair and fell two additional times within a 5 minute timeframe. After the third fall to the floor, Child #3 crawled across the room with the highchair attached to their body.
4. Staff #1 stated they had no knowledge of Child #3 falling three separate times while restrained in the highchair and confirmed that they were responsible for supervising and caring for Child #3.

Plan of Correction: Precious Pearls Polices have been in place at the time of employment. Staff #1 did not follow precious Pearls policies and procedures therefore, Staff #1 has been terminated.

High chairs have been removed permanently.
