8VAC20-790 Subsidy Program Vendor Requirements for Subsidy Providers

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
A Subsidy Health and Safety Inspection was conducted on 6/22/2023 from 10:40am through 11:30pm. There were four children directly supervised by the vendor. During the inspection the home, activities and interactions with children, emergency supplies, procedures and drills were inspected. During the inspection, the children were observed eating breakfast and watching TV on their tablets on the vendors couch. The vendor is not currently trained to administer medication and the vendor stated that no medication was on-site. Four children's records, vendor information and household member information was reviewed.

Information gathered determined violations with applicable code or requirements and are listed on the Violation Notice.

Description: REPEAT VIOLATION
Based on interview, the vendor does not maintain a written record of attendance that documents the arrival and departure of each child.
Evidence: The vendor stated that they do not document daily attendance.

Description: REPEAT VIOLATION
Based on record review and interview, children's records did not include all required information.
Evidence: 4 out of 4 children's records did not contain proof of each child's identity. The vendor stated that the families had not provided proof of identity.

Description: REPEAT VIOLATION
Based on observation and interview, bathrooms were not equipped with all required supplies.
Evidence: The children's bathroom does not contain hand soap or disposable paper towels. When asked how the children wash their hands, the vendor stated someone must have taken the soap and pointed to paper towels located above the refrigerator in the kitchen.

Based on observation, children over 12 months were not provided with a cot, rest mat or bed.
Evidence: Child #1 was observed taking a nap on the vendors couch where three other children played.
