Comments:
An unannounced complaint inspection was conducted on-site August 16, 2023 and concluded October 3, 2023. A complaint was received by the Department regarding termination and staffing and supervision. The director was available during the inspection. The inspector reviewed compliance in the areas of administration and staffing and supervision, interviews were conducted, and records reviewed.

The evidence gathered during the investigation supported the allegation of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.
Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Complaint related: Yes
Description: Based on a review of records and interview, the licensee failed to ensure that the center's activities, services, and facilities are maintained in compliance with the center's own policies and procedures that are required by these standards.
Evidence: 1. In an interview with an outside witness it was stated that child #1 was unenrolled "unfairly" on 08/03/2023.
2. In an interview with staff #1 on 08/16/2023 it was confirmed that child #1 was terminated immediately due to a parent refusing an in-person meeting.
3. The center's policies regarding termination states "There are no limits to the services that the Center can provide. At any time that the Center feels it is not able to meet the child's needs; the Center may give a two week notice to the parent/guardian to terminate services. In extreme circumstances, where the child is endangering him/herself or others, we reserve the right to waive the two-week dismissal notice."

Description: Based on interview, the center failed to inform the Department's representative of any injury that occurs while the child is under the supervision of the center and requires outside medical attention.
Evidence: In an interview with staff #1 it was stated that the center received a message from a parent in the Bright Wheel app. on 08/02/23, that child #1 was taken to the emergency room. The center did not notify the Department of Education Office of Child Care Health and Safety that the child was taken for outside medical attention.
