Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements.

Comments:
An unannounced monitoring inspection was conducted on 5/14/24 from 8:45am to 11:55am with the Director. There were 165 children in care, ranging in age from eight-weeks to five-years-old, supervised by 24 staff. The children were observed participating in circle time, reading books, practicing for graduation, having diapers changed, and drinking bottles. Six child records and six staff records were reviewed. The Center has 46 staff with current certification in CPR and First Aid, and 46 staff trained in Daily Health Observation. A sample of six medications and authorization forms were reviewed, and the center has nine staff current in Medication Administration Training (MAT). Required postings were observed. The attendance, menu, allergy list, and emergency drill log were reviewed. The most recent Fire Inspection on file was dated 2/5/24 and the most recent Health Inspection on file was dated 4/12/24. Description: REPEAT VIOLATION Based on review of six child records, the center did not obtain documentation that each child had received required immunizations before the child attended the center. Evidence: The immunizations on record for Child F, with a start date of 7/31/23, were dated 11/27/23.

Standard #: 8VAC20-780-140-A
Description: Based on review of six child records, the center did not obtain documentation of a physical examination for each child by or under the direction of a physician within 30 days after the first day of attendance. Evidence: The physical on record for Child A, with a start date of 12/14/21, was dated 3/24/22. The physical on record for Child F, with a start date of 7/31/23, was dated 11/27/23.

Standard #: 8VAC20-780-80-A
Description: REPEAT VIOLATION Based on observation, review of documentation, and interview, the center did not ensure that for each group of children, a written record of daily attendance was maintained that documented the arrival and departure of each child in care as it occurred. Evidence: 1. At approximately 8:48am on 5/15/24, 11 children were observed in Class #614. The attendance contained documentation of 15 children present. 2. At approximately 8:58am on 5/15/24, 18 children were observed in Class #613. The attendance contained documentation of 12 children present. 3. At approximately 10:05am on 5/15/24, 18 children were observed in Class #618. The attendance contained documentation of 21 children present. A staff member then updated the attendance to show that one additional child had arrived at approximately 9:30am, and four had transitioned to another class at 9:30am.

Standard #: 8VAC20-780-350-B-3
Description: Based on observation, the center did not ensure that the required ratio of one staff to eight two-year-old children was met. Evidence: On 5/15/24 at approximately 8:55am two staff were observed supervising 18 two-year-olds. At approximately 9:01am four children were transitioned back to their classroom, putting the two-year-old class back into ratio.

Description: Based on observation, the center did not ensure that the required ratio of one staff to 10 three-year-old children was met. Evidence: On 5/15/24 at approximately 8:48am one staff was observed supervising 11 three-year-olds. A second staff did not enter the classroom until approximately 8:55am.

Description: Based on observation, the center did not ensure that children?s hands were washed with soap and running water after toileting. Evidence: In Class #609 multiple children were observed having their diaper changed and returning to play without having their hands washed.

Standard #: 8VAC20-780-500-B
Description: Based on observation, the center did not ensure that diaper changing surfaces were cleaned with soap and water and sanitized after each use. Evidence: In Class #609 for children 16-months through 23-months, a staff member was observed changing children?s diapers and using a sanitizer spray in between children, but no soap and water spray was used.
