Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements.

Comments:
An unannounced inspection was conducted with the Director on 6/20/24 from 2:15pm to 3:00pm in response to a self-report made by the center relating to a forbidden action- verbal remarks demeaning to a child. Documentation was reviewed and an interview conducted. Information gathered during the inspection determined non-compliance with applicable standards and a violation was documented on the violation notice issued to the program.

Please complete the "Plan of Correction" and "Date to be Corrected" areas on the Violation Notice for the violation cited, sign, and return the inspection to me by the close of business on 6/21/24. Plans of correction should include steps to correct the noncompliance with the standard, and measures to prevent the noncompliance from occurring again.

Description: Based on review of documentation and interview, the center did not ensure that a forbidden action, verbal remarks which were demeaning to a child, did not occur. Evidence: On 6/18/24 a witness reported that they heard Staff #1 say to Child A, a seven-month-old, ?Don?t start your crap, [child?s name].? Then shortly after, ?We just sat your ass in the chair [child?s name]. Wait.?

Plan of Correction: The staff member was immediately removed from the classroom and employment terminated.
