Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced monitoring inspection was conducted on June 26, 2024. The inspection began at 10:40am and ended at 12:40pm. The inspector reviewed compliance in the areas listed above. There were 18 children present and 4 staff. The inspector reviewed 6 children?s records and 5 staff record. This inspection included document review, tour of the facility, interviews, and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-160-A
Description: Documentation of a negative tuberculosis (TB) screening shall be submitted at the time of employment and prior to coming into contact with children. Staff #1 and Staff #2, re-hired for the summer, did not have documentation of a negative TB screening.

Plan of Correction: The center responded with the following: Director reported that last summer, both Staff #1 and Staff #2 had completed a TB screenings and both negative. The center is unable to locate the documentation of the TB screenings. Both staff members will have their TB screening redone.

Standard #: 8VAC20-780-580-B
Description: Any vehicle used by the center for the transportation of children shall meet the safety standards set by the Department of Motor Vehicles (DMV). The center?s transportation van used to transport children to and from fieldtrips has expired DMV State tags with a date of April 2024.

Plan of Correction: The center responded with the following: The Director will go to the Department of Motor Vehicles building to get up to date State tags for the transportation van. It was renewed the following day and the new expiration date for the State tags is April 2026.
