22.1 Background Checks Code, Carbon Monoxide

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was conducted on 6/3/24. The on-site inspection took place from 12:10 om to 1:10 pm. The inspector reviewed compliance in the areas listed above. There were 4 child present with 1 caregiver. The inspector reviewed 4 children and 2 caregivers records.The inspection included document review, a tour of the daycare area, interview and observations.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.036-A
Description: Background checks are required every five years after the initial background checks.
Caregiver #1's Sworn Disclosure Statement had not been obtained for 2 months beyond the five years, their Central Registry Child Abuse and Neglect background check had not been obtained for 7 days beyond the five years and their Fingerprint background check had not been obtained in almost a month beyond the five years.

Plan of Correction: I will obtain the repeat background checks.

Standard #: 8VAC20-800-120-B
Description: Caregivers records shall contain two or more references as to character and reputation as well as competency are checked before employment.
There were no references checked for Caregiver # 2 for 23 months after employment.

Plan of Correction: Caregiver #2 will no longer be working at the family day home.

Standard #: 8VAC20-800-90-A
Description: Before a child may attend the family day home, the provider shall obtain documentation that the child has been adequately immunized.
There were no immunization record on file for child A for 5 months after attending the family day home.

Plan of Correction: I will obtain the affidavit from the parent that immunizing agents conflict with their religious beliefs.

Standard #: 8VAC20-800-200-A
Description: The provider shall orient caregivers by the end of their first week of assuming job responsibilities.
Caregiver #2 was not provided orientation training approximately 1 year and 11 months after assuming job responsibilities.

Plan of Correction: Caregiver #2 will no longer be working in the family day home.

Standard #: 8VAC20-800-210-A
Description: Caregivers shall obtain a minimum of 16 clock hours of training annually in areas relevant to their job responsibilities.
Caregiver #2 has obtained none of the required 16 hours of training from June 2022 to June 2023.

Plan of Correction: Caregiver #2 will no longer be working at the family day home.
