Comments:
An unannounced code compliance inspection was initiated on 4/20/2022 and concluded on 4/27/2022 from 10:00 AM to 11:00 AM. There were four children present, ranging in ages from three to four, with two staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision and procedures. A total of two children?s records and two staff?s records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22.1-289.031-B-6
Description: Based on record review and interview, the center failed to establish and implement a procedure to ensure that all staff are able to recognize the signs of child abuse and neglect.

Evidence:

1. The first day of working with children for staff 1 and staff 2 was 8/16/21 per the director.
2. The record for staff 1 has documentation of completing training in recognizing child abuse and neglect on 4/12/22.
3. The record for staff 2 has documentation of completing training in recognizing child abuse and neglect on 3/13/21.
4. The director stated until recently she was unaware of the requirement.

Plan of Correction: All new staff will be required to complete training in recognizing child abuse and neglect prior to working with children.

Standard #: 22.1-289.035-B-2
Description: Based on record review and interview, the center failed to obtain fingerprint-based criminal history check determination letters prior to the first day of employment.

Evidence:

1. Staff 1?s date of hire was 8/1/21. The fingerprint-based criminal history check determination letter is dated 11/30/21.
2. Staff 2?s date of hire was 8/1/21. The fingerprint-based criminal history check determination letter is dated 12/9/21.
3. The director verified the dates.

Plan of Correction: In the future new potential employees will not be hired until the 1 fingerprint-based criminal history check determination letter has been received.

Standard #: 8VAC20-770-40-D-2
Description: Based on record review and interview, the center failed to have staff sign a sworn disclosure statement prior to the first day of employment and have a completed central registry record check by the end of the 30th day of employment.

Evidence:

1. Staff 1?s date of hire was 8/1/21. The sworn statement is dated 11/24/21 and a central registry was not completed.
2. Staff 2?s date of hire was 8/1/21. The sworn statement is dated 11/24/21 and a central registry was not completed.
3. The director verified and the dates. The central registry was started but not completed in error.

Plan of Correction: In the future new staff will be required to complete sworn statements and the paperwork for central registry upon hire. The central registry paperwork will be mailed within the first seven days of employment. Within 30 days after employment if the central registry results have not been received the director will follow up and document the file. The central registry paperwork for staff 1 and staff 2 will be completed and mailed off by the end of the week. The results will be forwarded to licensing.
